The rapporteur of the case, Deputy Ricardo Maia, from MDB of Bahia, stressed that the attitudes of the parliamentarian were incompatible with the decorum required for the exercise of the mandate. “The facts go beyond a simple political divergence or a heated rhetorical clash,” Maia considered. “The manifestations go beyond the limits of freedom of parliamentary expression, with personal attacks and moral disqualification, through offensive and disrespectful, who hurt the dignity of the affected authorities and compromise the institutional values ​​of the House of Representatives,” said the rapporteur.

In his defense, Gilvan argued that the process was unfounded. “A sanctioning process was established, devoid of large evidence to demonstrate the breakdown of decorum of the defendant, substantiated solely in evidence that tarnates the purpose of the objective,” he said.

This is not the first controversial episode involving the deputy. Gilvan had already been involved in other cases, including statements in which he wished the president’s death.
