The court complied with a request from the US government to overthrow the suspension of the measure by lower instances

The Supreme Court of the United States decided on Tuesday (6.MAI.2025), by 6 votes to 3, that the president’s (Republican) government can ban transgender people from joining the Armed Forces and expel those who are already. The measure had been suspended by decisions of lower instances.

None of the magistrates disclosed the justifications of their votes. The case continues to be processed in the 9th US Appeals Court, but the government can now implement the measure. The information is from ABC 7.

In April, the government to the Supreme Court authorization to apply the decree, signed at the beginning of Trump’s 2nd term, which revokes an earlier guideline from the former president (Democrat), who had allowed the open service of transgender people.

A week later, Trump issued a new executive order reinforcing the ban on trans people in the Armed Forces, arguing that different gender identities would affect military discipline and cohesion. In February, the Defense Department began to apply the measure, determining the dismissal of transgender military.

Policy is part of a set of actions of the current republican administration that seek to restrict rights of the LGBTQIA+population.
