The first class of the Supreme Federal Court (STF) ruled on Tuesday (6) to make defendants seven another reported by the scammered plot during the government of former President Jair Bolsonaro.
Unanimously, the five ministers of the collegiate accepted the Army military and a federal police officer who are accused of organizing misinformation to propagate false news about the electoral process and virtual attacks on institutions and authorities through the structure of the Brazilian Intelligence Agency (Abin). The case became known as “parallel Abin”.
The votes were given by the ministers Alexandre de Moraes, rapporteur of the case, Flávio Dino, Cármen Lúcia, Luiz Fux and Cristiano Zanin.
With the decision, the following accused became defendants:
- Ailton Gonçalves Moraes Barros (Major of the Army Reserve);
- Ângelo Martins Denicoli (Major of the Army Reserve);
- Giancarlo Gomes Rodrigues (Army Lieutenant);
- Guilherme Marques de Almeida (Army Lieutenant Colonel);
- Reginaldo Vieira de Abreu (Army Colonel);
- MARCELO ARAÚJO BORMEVET (Federal Police);
- Carlos Cesar Moretzsohn Rocha (President of the Voting Legal Institute)
The accused will be responsible for five crimes: armed criminal organization, violent abolition of the Democratic Rule of Law, coup, damage qualified by violence, serious threat, against the union’s assets and deterioration of listed heritage.

The trial score was obtained with the vote of the rapporteur, Alexandre de Moraes.
According to the minister, the PGR complaint “satisfactorily described” that the accused contributed to disclosure fake news about the electronic ballot boxes and against the electoral system by social networks.

“There was the distribution, the production of fraudulent attacks on attack against the judiciary, to the STF, to the TSE, to the smoothness of the elections, to the issue of the ballot box. The accused were part of this structure, within a criminal organization,” he said.
Moraes also said the PGR complaint pointed to the use of Firstmile monitoring software to illegally monitor Bolsonaro’s disaffected. The minister mentioned that the investigations found that one of the accused conducted 887 illegal polls through the program.
“The gathered elements indicate that the group infiltrated at Abin Ali were installed at the beginning of the term Jair Bolsonaro in 2018, and was the author of virtual attacks from various targets that contradicted interests,” he said.

The rapporteur also pointed out that the targets of virtual attacks were chosen from Bolsonaro’s public statements.
“The actions gain even more relief when observing the consonance between the public discourses of Jair Messias Bolsonaro and the targets chosen by the infiltrated cell in ABIN,” he added.
Moraes also argued that the investigations also show the group’s performance to carry out virtual attacks on the then Army Commander, General Freire Gomes, and the Air Force Commander, Brigadeiro Batista Júnior, for not joining the coup proposal.

“The instrumentalization of these messages is for the coercion of the Army Commander-General by other military.

During the trial, Minister Cármen Lúcia also condemned the dissemination of misinformation and said that the lie became commodity on social networks.
“It’s the lie as a commodity. It has become a good, you pay for it, there are those who win, there are those who do. The lie as commodity to buy antidemocracy,” he said.

Criminal action
With the acceptance of the complaint, a criminal action will be opened at the Court. The opening marks the beginning of the procedural instruction, in which lawyers may indicate witnesses and ask for the production of new evidence to prove the defense theses.
The accused will also be questioned at the end of this phase. The works will be conducted by the office of Minister Alexandre de Moraes, rapporteur of the case.
After the end of the instruction, the trial will be marked, and the ministers will decide whether the former president and the other accused will be sentenced to arrest or acquitted.

There is no set date for the trial.
In case of conviction, the sum of the penalties for crimes goes from 30 years in prison.

During the trial, the lawyers countered the accusations and called for the rejection of the complaint.

To date, the complaints have been judged against nuclei 1, 2 and 4, totaling 21 defendants.
In March this year, unanimously, the
