Justice denies Nunes Tabata Indemnity – 08/05/2025 – Panel

Judge Priscilla Neves Netto rejected an indemnity action of R $ 50,000 for moral damages filed by the mayor of, (), against the federal deputy (-SP).

Last year, Tabata, who ran against Nunes, said during a debate that the mayor should adopt the slogan “steals and does not.”

Nunes then sued the deputy, claiming that he had his honor reached. “There was evident slander.”

In the action, he further stated that the attack was “unfair”, since it was made at a time of the debate in which he was no longer entitled to the word, that is, could not defend himself.

Tabata said in the defense presented to the court that he made a “political-administrative criticism typical and proper to the electoral process.” “Anyone who launches itself to public life must be used to the severe criticism that will be directed to him,” he told the court.

In the sentence, the judge stated that there was no violation of the mayor’s rights. “In the political debate, especially for the city of São Paulo, a large metropolis of national influence, it is possible that the moods of the candidates will be more exalted,” he said.

“There was no imputation of crime, but a discussion about the management of the author of the process in the City Hall. The expression ‘steals and does not’ do not give rise to slander or defamation, albeit disrespectful,” said the magistrate.

Nunes, who was ordered to pay the fees of Tabata Lawyers (R $ 7,500), can still appeal.
