Minister considers the deputy to blame for invading CNJ systems and is in favor of the loss of his mandate; Hacker involved in the case is sentenced to 8 years
The Supreme Court Minister Alexandre de Moraes voted on Friday (9.MAI.2025) to condemn the deputy (PL-SP) to 10 years in prison. The 1st Panel of the Court began to judge in the Virtual Plenary the criminal action in which Zambelli and hacker Walter Delgatti are defendants for the crimes of invasion of the computer system and ideological falsehood.
According to the prosecution of the PGR (Attorney General’s Office), the congressman commanded the invasion of the CNJ (National Council of Justice) system to issue an arrest warrant of Moraes, as if he himself was determining his own arrest. Read the vote (PDF – 1 MB).
Moraes also voted in favor of the loss of Zambelli’s mandate, which should be declared by the Board of Directors of the Chamber of Deputies. The magistrate also determined the ineligibility of the deputy for 8 years.
“In the event of the parliamentary’s final arrest period, to be fulfilled in a closed regime, to be more than 120 days, the criminal conviction will result in the loss of the parliamentary mandate, regardless of the deliberation of the legislative body of which the defendant is part.”declared the minister.
In his vote, Moraes explained that, according to article 55 of the Constitution, the loss of mandate in the case of arrest of a congressman dispenses with the legislative debate and the board of directors of the house should only approve the decision.
The congressman and Delgatti, who has been sentenced to 8 years and 3 months in prison, will still have $ 2 million in compensation for collective material and moral damages. The amount must be destined to a fund managed by a Federal Council or state councils of the Public Prosecution Service to reconstruct the injured goods.
The ministers of the 1st class still need to vote for the conviction of the defendants and can modulate the penalties. The virtual session ends at 11:59 pm on May 16. After the trial, the defenses can still appeal.

Revoked mandate
