Deputy and Hacker are accused of forging arrest warrant against Moraes; PGR calls for conviction for digital crimes and ideological falsehood
The Supreme Court (STF) will start, on Friday (9.MAI.2025), to the judgment of the Federal Deputy (PL-SP) and hacker Walter Delgatti. Both are accused of involvement in the CNJ (National Council of Justice).
The PGR (Attorney General’s Office) requested that the 2 be condemned by the crimes of invasion of electronic device and ideological falsehood. The analysis of the 1st class of the Supreme Court will be in the virtual plenary session, lasting until May 16th. The rapporteur of the case is Minister Alexandre de Moraes.
Infringement by invasion of electronic device provides for imprisonment of 1 to 4 years, while the crime of ideological falsehood can result in a penalty of 1 to 5 years in prison. In the request for conviction, the Attorney General, Paulo Gonet, requested that the article of the Penal Code be considered authorizing the increase of the penalty of 1/3 to 2/3, in cases where the invasion causes financial damage.
According to PGR, Carla Zambelli and Walter Delgatti would have participated in the creation and disclosure of a false arrest warrant against Alexandre de Moraes, forged as if he had been authenticated by the magistrate himself. This document was eventually inserted in the BNMP (National Bank of Arrest Warrants), which is maintained by the National Council of Justice.
In the final allegations of the process, Carla Zambelli’s defense requested her acquittal, arguing that the investigated acts were exclusively performed by Walter Delgatti.
“The insertion of the arrest warrant is the product of individual and isolated conduct of the defendant that invaded the BNMP system and inserted the ideologically false document to subsequently send it to the supplicant in an attempt to self-promote, as previously done. At no time, the supplicant determined, commanded, instigated or asked him to act like this ”said the defense, commanded by lawyer Daniel Bialski, according to the newspaper The globe.
Delgatti recognized the facts, but pointed out Zambelli as responsible. His lawyers asked for the reduction of the sentence, noting that he collaborated with the investigations. “Carla Zambelli’s performance was clear as homeless and intellectual mentor of the invasions, offering support, employment, benefits and even costing Walter’s treatment at Guaratinguetá Hospital ”declared lawyer Ariovaldo Moreira.
