What does the Constitution say about the calculation of the number of deputies?

How many federal deputies are there today in the country? How many will there be if the project is approved?
Currently, the House of Representatives has 513 federal deputies. If the bill becomes law, the number will rise to 531.

Which states will you win deputies if the bill becomes law? And which one will lose?
If the proposal comes into force, no state will lose representatives in the House, and nine will win. They are Pará and Santa Catarina, who will have four deputies each other; Amazonas, Mato Grosso and Rio Grande do Norte, which will earn two each; and Goiás, Ceará, Paraná and Minas Gerais, who will have one more deputy each.

What is the justification of the House to approve the project?
The House says that the proposal is in decision of the Supreme Court on the subject while preventing states from losing deputies in the next legislature.

What had the STF decided on the subject?
In August 2023, at the request of Pará, the Supreme Court determined that the number of federal deputies per federative unit measured by the 2022 census. The Court determined that the Congress must issue law on the subject until June 30, 2025. If the deadline is not fulfilled, the Supreme Court provides that the (Superior Electoral Court) will establish the number of deputies per unit of the Federation by the Federation. 2027.

Has the STF determined that the House will increase the number of deputies?
No. The Court decided that the number of deputies should be readjusted according to the population, without determining an increase in the number of vacancies in the House. A possible alternative to comply with the decision, for example, would be redistributing the current 513 vacancies among the 27 federation units.

Which states will you lose deputies if the number of deputies does not increase?
If the bill approved in the House does not enter into force, seven states may have the number of deputies reduced in the next legislature for the STF’s decision to be complied with. They are Alagoas (1), Bahia (2), Paraíba (2), Pernambuco (1), Piauí (2), Rio de Janeiro (4) and Rio Grande do Sul (2). Another seven would win deputies: Amazonas (2), Ceará (1), Goiás (1), Minas Gerais (1), Mato Grosso (1), Pará (4) and Santa Catarina (4).

Is there an increase in spending if the project is approved? How much?
The House calculates at R $ 64.6 million per year the increase in costs with the creation of vacancies of deputies, including wages, benefits and structure for new parliamentarians. The rapporteur of the proposal, Deputy Damião Feliciano (União Brasil-PB), states that this amount will be absorbed by the current budget.

The total impact, however, must be greater, since these deputies may indicate amendments to the budget. In addition, there will be costs for legislative assemblies, as the Constitution binds the number of state deputies to federal.

What are the next steps of the process?
The bill now goes to Senate analysis, which is up to June 30 to vote it. Approval requires absolute majority (257 votes). If you pass the house, the text goes to the sanction of the President of the Republic. If the Senate does not deliberate on the subject by June 30, the STF’s decision provides for the TSE to define the number of chairs per unit of the federation.

What do critics say to the proposal?
Deputies against the bill state that the text swells the House and increases public spending. In addition, they question the absence of deeper debates on the subject.
