Defensoria asks the army to enlist rule for trans – 10/05/2025 – Panel

The Union sent to the commander of the general, recommendation to prepare a specific protocol to attend to which they want to enlist in compulsory military service.

The army has 15 days to speak whether or not the recommendation will accept.

The document is signed by the National Defender of Human Rights, Carolina Castelliano, by the Regional Defender of Human Rights of Alagoas, Diego Alves, and by federal public defenders Sérgio Caetano Conte Filho, Ivan de Oliveira Ferreira, Atanásio Darcy Lucero Junior and Marcos Wagner Alves Teixeira, who are part of the LGBTQIA+ DPU Working Group.

The recommendation, dated last Wednesday (7), cites reports of a trans person in Maceió (AL) who said he had gone through discriminatory situations during the enlistment.

The candidate said he was taken with four other young people to a room to undergo physical evaluation. There, he was forced to take off his clothes, even after reporting to be a trans man and to signal that he felt uncomfortable with removing the clothes with the men present. The argument was that it was a regular army protocol.

The Regional Call Plan of the 7th Military Region provides for the approach to LGBTQIA+ Corte and respectful people. It also prohibits that the citizen be embarrassed and guarantees the use of the social name. According to the Defender, “there is an indicative that such rules are not being fully implemented by military service professionals.”

DPU also recommends that social name is allowed from the first contact. It also suggests detailed norms related to the LGBTQIA public+ in physical and health assessments as part of the military enlistment procedure, with privacy guarantee, possibility of individual care and choice of health professional genre.

The Defender’s Office proposes that educational measures aimed at employees of military service joints and members of the selection committees for the proper treatment of trans’s persons, as well as the implementation of a permanent and accessible channel to receive allegations of human rights violations and inadequate treatment of LGBTQia+persons, with guarantee of confidentiality and effective investigation.
