Spanish family receives a record compensation of 3.7 million euros for being run over

Value exceeds the compensation of a Spanish citizen who was run over in 2016 and who, before any rehabilitation, remained hospitalized for more than a year.

A Spanish family was recently compensated at 3.7 million euros, in the one that is considered the highest value ever awarded in Spain by a road accident. , the case dates back to 2023, when the seven -year -old’s son was hit by a car who was circulating according to traffic rules.

The accident occurred when the child crossed the road between two parked cars, eventually being harvested by the vehicle. The injuries suffered were serious and irreversible: the minor lost the ability to walk and speak, and in need of permanent care.

With the hospitalized son a week ago and with a very reserved prognosis, the couple, still in shock, saw the case delivered to a legal team that promptly claimed that the child could not be held responsible for the succeeded.

The legal way that the family’s lawyers followed, in order to claim compensation, was to dispense with any kind of responsibility of the victim, because it was a under 14 years, regardless of the vehicle followed within the road standards. That is, as it is a child under 14 years old, the law exempts it to responsibilities, since, according to the Spanish Civil Code, it is not fully able to discern between right and wrong and, therefore, an adult in the same situation of the child would not receive compensation.

The record value was defined after an extrajudicial agreement between the family’s lawyers and the driver’s insurer. The amount covers expenses with family housing adaptations, travel to medical treatments – already made in Madrid and a center specializing in neurosurgery and rehabilitation in Barcelona – and hiring a specialized caregiver. The child currently has a degree of disability of 98%, according to medical evaluation cited by the newspaper.

Other factors such as the conditioning of parents’ personal and professional life, which, according to the Spanish newspaper, have a precarious socioeconomic condition, the loss of a future career of the child, the purchase of a wheelchair, as well as the necessary adaptation for vehicles where the smallest will be taken into account to reach 3.7 million euros, exceeding 3.3 million euros (the largest compensation to date, in a highway accident).
