The First Class of the Federal Supreme Court (STF) formed on Friday (9) majority of votes to condemn Mrs Carla Zambelli (PL-SP) to 10 years in prison for the invasion of the Electronic System of the National Council of Justice (CNJ) in 2023.
So far, the rapporteur of the case, Alexandre de Moraes, and the ministers Flávio Dino and Cristiano Zanin have manifested in favor of the condemnation for the crimes of invasion of the computer device and ideological falsehood. The votes of Luiz Fux and Cármen Lúcia are missing.
In addition, the ministers welcomed the part of the Moraes vote authorizing the loss of the deputy’s mandate after the end of all possible resources.
According to the complaint of the Attorney General’s Office (PGR), Zambelli was the intellectual author of the invasion to issue a false arrest warrant against Minister Alexandre de Moraes. According to investigations, the hacking was executed by Walter Delgatti, who is a confessed defendant.
The STF’s decision also condemns the hacker to 8 years and 3 months in prison and the payment of R $ 2 million for collective moral damages, which should be divided with the parliamentarian.
Defense
In a press release, Carla Zambelli’s defense challenged a virtual trial to condemn the deputy. Lawyers also considered “absolutely unfair” that the parliamentarian be condemned “without irrefutable evidence.”

“Absolutely unfair that the deputy was tried and condemned without irrefutable and undoubted evidence, especially for facts that he was unaware of, such as the false permits that Mitoman Walter [Delgatti] He made it to his cousin and third people. It should be noted that it will never be believed in court and one of the ministers is expected to ask for a view and examine all the arguments released by the defense and, in the future, modify the course suggested by the rapporteur, ”said the lawyers.
Elections
Carla Zambelli responds to another criminal case in the STF. In August 2023, Zambelli turned back to the Supreme Court for the episode in which she drew a firearm and chased journalist Luan Araújo on the eve of the second round of the 2022 elections.
The persecution began after Zambelli and Luan exchanged provocations during a political act in the Jardins neighborhood of São Paulo.

To date, the Supreme Court has registered a score of 5 votes to 0 to condemn the parliamentarian to 5 years and 3 months in prison in semi -open regime. However, a request for a view of Minister Nunes Marques postponed the conclusion of the trial.
