During the final discussions, Efain Mendonza, prosecutor, stressed that Tarcisio was silent during the relationship and knew the victim’s psychological problems.
“She made contact with the support network, but had no effect. Husband Tarcisio knew the problems faced and did not support. He was aware of it and did not support. He knew the trauma and that it caused suffering to her. Machismo caused her to be subdued by him; I didn’t even want to know about the medicine she took,” he said.
He also pointed out that the lack of care for firearms at the residence is an aggravating factor.
“The spaces where this weapon was stored were easily accessible. The weapon was seen in a closet, common use of the victim. The accused himself said that. The place was so accessible that at the time of his death, she was able to reach her. There were no signs of strength or that the place was broken into,” he said, adding that the fact that the victim has psychological problems further aggravates the neglect of the weapon storage.
Mendonza also stated that the victim’s history with weapons makes the issue even more sensitive, as it aggravates the weight of omission and lack of care by Tarcisio.
“He took a person who was treating a mental question of treatment. The prosecutor is not defining him as a criminal, we never said that he wanted the victim’s death, but we claim that he contributed it through his omissions,” he said.
The prosecutor added that, even if the complaints were limited to this point, it would be possible to qualify homicide by omission, but that the actions went beyond.
“He said, ‘That was not clothing, one thing is on stage, another on the street.’ Several witnesses reported offenses made to the victim for clothes and hair, as well as the attempt to control her life. He tried to submit Nayara to his whims, which can configure femicide,” he said.
Mendonza also mentioned videos in which Tarcisio appears encouraging the singer to commit acts against her own life, saying phrases such as: “Go ahead, kill yourself.”
The accused’s lawyer will hold the final allegations by memorials, in a written document, with a period of five business days. The material may be delivered until May 19th.
