Federal Deputy Carla Zambelli (PL-SP) says she is the victim of “political persecution” and the loss of the parliamentary mandate. The conviction is linked to the invasion of the National Council of Justice (CNJ) system, in a criminal action that also involves hacker Walter Delgatti Neto.

“I am being the victim of political persecution that is not only against my personal honor, but also against the most elementary principles of the rule of law. What is on trial are not concrete actions, but my firm stance, active voice and my unwavering defense of the conservative values ​​I represent,” he wrote in a statement published on social networks.

The trial began on Friday (9) and is scheduled to end on May 16. To date, ministers Alexandre de Moraes (rapporteur), Flávio Dino, Cármen Lúcia and Cristiano Zanin have voted in favor of the conviction, including the loss of mandate, ineligibility and payment of a fine. Ministers Luiz Fux has not yet commented.

In the same process, the Supreme Court also judges Walter Delgatti, which would have executed the attacks on the CNJ system under the guidance of the deputy. He was sentenced to 8 years and 3 months in prison, in closed regime, in addition to a fine. Delgatti is already in prison preventively.

In his vote, Moraes stated that Zambelli had “full knowledge of the unlawfulness of his conduct, acting in a premeditated, organized and conscious way, in search of reaching basic institutions of the Democratic Rule of Law, especially the judiciary.” According to him, Delgatti inserted at least 16 fake documents in 13 distinct invasions to the CNJ system.

Among the fraudulent archives are a false arrest warrant against Alexandre de Moraes himself – forged as if he had been signed by him – and an alleged decision to break the minister. This last document, according to the Attorney General’s Office (PGR), was created on Delgatti’s computer and accessed 22 seconds later by Zambelli. “This technical proof is irrefutable and demonstrates, in addition to any reasonable doubt, the direct involvement of the accused Carla Zambelli Salgado de Oliveira in the crimes imputed to her,” said the rapporteur.

What the defense says

Zambelli’s defense, however, still sees the possibility of reversing the partial result. According to a note signed by lawyer Daniel Bialski, “one of the ministers is expected to ask the process to evaluate all the arguments presented by the defense and eventually change the direction indicated by the rapporteur.”

In a press release, Carla Zambelli’s defense challenged a virtual trial to condemn the deputy. Lawyers also considered “absolutely unfair” that the parliamentarian be condemned “without irrefutable evidence.”

“Absolutely unfair that the deputy was tried and condemned without irrefutable and undoubted evidence, especially for facts that he was unaware of, such as the false permits that Mitoman Walter [Delgatti] He made it to his cousin and third people. It should be noted that it will never be believed in court and one of the ministers is expected to ask for a view and examine all the arguments released by the defense and, in the future, modify the course suggested by the rapporteur, ”said the lawyers.

Carla Zambelli responds to another criminal case in the STF. In August 2023, Zambelli turned back to the Supreme for the episode in which she drew a firearm and chased journalist Luan Araújo until she reached a bakery in the gardens in Sao Paulo on the eve of the second round of the 2022 elections.

The persecution began after Zambelli and Luan exchanged provocations during a political act in the Jardins neighborhood of São Paulo.

To date, the Supreme Court has registered a score of 5 votes to 0 to condemn the parliamentarian to 5 years and 3 months in prison in semi -open regime. However, a request for a view of Minister Nunes Marques postponed the conclusion of the trial.
