The First Class of the Federal Supreme Court (STF) to order on Friday, 9, federal deputy Carla Zambelli (PL-SP) for the invasion of the systems of the National Council of Justice (CNJ). So far, the ministers Alexandre de Moraes, rapporteur of the process, Cristiano Zanin and Flávio Dino have voted.
Moraes proposed the conviction to 10 years of imprisonment, in an initial closed regime, to the deputy. With the sentence, she loses her mandate in the House. The rapporteur was accompanied by ministers Flávio Dino and Cristiano Zanin (president of the first class). There are still vote for Cármen Lúcia and Luiz Fux.
Hacker Walter Delgatti Neto, who would have been co -opted by Zambelli to commit the crime, is also being tried. Moraes voted for his conviction 8 years old 3 months in prison.
So far, only Moraes has presented a vote in the virtual plenary. Dino, in turn, accompanied the rapporteur.
The attack on CNJ systems took place in January 2023. In the crime was issued a fake arrest warrant against Moraes. “The arrest warrant is issued to the detriment of myself, Alexandre de Moraes. Publish, submit and do L,” said the fake document.
A blockade receipt of R $ 22.9 million in the minister was also produced. The amount corresponds to the fine imposed by Moraes to the PL, party of former President Jair Bolsonaro, for questioning the electronic ballot boxes in the 2022 elections. There was also a false order, to break the minister’s bank secrecy.

The rapporteur of the lawsuit, Alexandre de Moraes, said in the vote that Zambelli and Walter Delgatti maintained a “umbilical connection” with “anti -republican goals.” Moraes also associated the hacker attack on the scammer acts of January 8. “The temporal correlation between these events is not merely coincidential,” he said.
The minister also said that Zambelli sought to attack the credibility of the judiciary. The rapporteur also states that the practice sought to exhibit “falsely its weaknesses simulating nonexistent judicial acts” and is a “recurring strategy in processes of democratic erosion”.

The rapporteur described that Zambelli’s participation, according to Delgatti’s version, was corroborated by police documents and reports, as well as in the testimonies of the witnesses heard.
“The most significant probative element to corroborate the version of the accused Walter Delgatti Neto consists of the location of identical files in the electronic devices of both accused,” Moraes pointed out.

“The crimes committed are inserted in a broader context of attempted rupture of the constitutionally established order,” said Zanin.
Also according to the minister, the CNJ systems were not invaded in a “random” way by Zambelli and Delgatti.
“It emerges sharply that the conduct of invading systems of the National Council of Justice and issuing false documents and expedients, including arrest warrant against the Minister of the Supreme Court, was not random. The materiality and authorship are duly proven, pursuant to the vote of the eminent rapporteur,” Zanin said.
