Project simplifies requirements for developments with ecological impact, but faces criticism of risks to environmental protection and inspection
A) It begins to discuss the project that creates a general law of environmental licensing in Brazil on Tuesday (13.mai.2025). An agreement signed between one of the project rapporteurs, the Senator (MDB-RO), and (PT-BA) is to be voted on the CMA on May 20, and on the 21st.
The main objective of the text is to establish general rules for licensing activities or projects that use environmental resources, whether potentially polluting or capable of causing environmental degradation. To the Poder360Confucius said he expects the PL to be approved in the 2 collegiate and in plenary.
One of the project points is the creation of the so -called LAC (license for adhesion and commitment). In this modality, the person responsible for the work declares, on his own, that he will comply with all environmental rules – and thus he gets the license automatically, without the environmental agency to technically evaluate the case before.
Another highlight is the unique environmental license, which brings together, in one document, the authorizations to build and operate the enterprise. Licensing exemption for low impact activities and the ability to regularize businesses that work without environmental license are also planned.
PL is seen as a way to combat bureaucracy and increase legal certainty for investors. However, environmentalists and civil society organizations point to risks of setback, as, according to them, the project can weaken environmental control and can facilitate disasters such as Mariana and Brumadinho.
