Bolsonaro asks the Supreme Court to cancel witness hearings in action on coup

Former President Jair Bolsonaro (PL) asked on Tuesday (13) to Minister Alexandre de Moraes of the Supreme Court (STF), who cancel the hearings with the witnesses listed in his defense in the process that investigates the 2022 coup plot (19).

Bolsonaro’s defense argues that it will not have enough time to analyze the new evidence made available by the Federal Police (PF) through a cloud link. The in a decision published on Monday (12), following a recurring request from the seven defendants’ defenses in the case.

According to Bolsonaro lawyers, access to documents is essential to be able to prepare properly for testimonials, question witnesses and evaluate the need to include new names in the witness list or to request other steps.

“[Requer-se] The cancellation of the hearings designated for sufficient instruction and granting of sufficient deadline for the probative set that remained out of the process is analyzed by the defense, in order to allow not only the necessary complementation of the proceedings and witnesses already presented, but also and especially the adequate questioning of witnesses listed by the parties, ”argues the defense in the document filed in the STF.

Evidence includes data from cell phones, computers and documents seized throughout the investigation. For Bolsonaro lawyers, the volume of information and the complexity of the material makes analysis unfeasible in a short time before the testimony of the witnesses.

Investigation

Bolsonaro is one whose purpose would be to prevent the inauguration of President -elect Luiz Inacio Lula da Silva (PT) in 2023. The group is accused of crimes such as attempted coup, criminal organization and violent abolition of the Democratic Rule of Law.

The process has advanced to the instructional phase, in which the witnesses will be heard and the evidence will be confronted. However, Bolsonaro’s defense now seeks to postpone this stage to ensure what he considers to be the right to broader.

The request for cancellation of the hearings is in the hands of Minister Alexandre de Moraes, who must decide whether to welcome the defense claim and establish a new schedule for the process instruction phase. The decision is expected to be released in the coming days.
