The bank justified the decision with the lack of government payment, the absence of money for coverage or the mistaken information that requests should be made through inoperative application.
The action cites the case of families of the victims of, Pelotas (RS), in October 2024.
There were also cases of those who could not enter insurance because of the system’s inoperability that allowed the request or refusal of Caixa Econômica Federal to make the service, virtually or in person.
The Defender’s Office also requested that the action stops the prescription, ensuring that the victims do not miss the legal deadline to request their rights in court.
DPU argues that non -payment of compensation can have serious consequences, especially for victims and their families, who are vulnerable and depend on the money to afford medical expenses and rehabilitation, for example.

The refusal to receive insurance, therefore, not only compromises the reparation of damage, but also hurts such rights, endangering the dignity and quality of life of the victims,” says an excerpt from the action.
