Justice of Spain maintains negative extradition of journalist Oswaldo Eustáquio

The national hearing of Spain, the main judicial instance for constitutional issues in the country, denied a new appeal from the Brazilian government that called for the extradition of journalist Oswaldo Eustáquio. The decision was issued on May 5 and maintains the understanding that the initially pointed out on April 15.

The Brazilian government, through the Attorney General of the Union (AGU), has already announced that it will appeal again. The new appeal will be presented by a lawyer hired in Spain by the Ministry of Foreign Affairs (MRE). AGU reported that it considers it necessary to adopt all appropriate measures to allow Eustáquio to be extradited and respond to processes in Brazilian territory.

Fugitive and target of investigations

Oswaldo Eustáquio is considered a fugitive from the Brazilian justice and has two open arrest warrants. The first is for threat and corruption of minors, with the Federal Police having tried to arrest him by determination of the Supreme Court (STF). The prosecution points out that he would have used his minor daughter’s social networks to attack public servants.

The second arrest warrant is related to the scammer acts of January 8, 2023, which aimed at the violent abolition of the Democratic Rule of Law in Brazil.

Itamaraty and the Ministry of Justice referred the case to AGU, which reaffirms the position that Eustáquio must be tried in Brazil. The new negative of Spain’s national hearing is a setback for the Brazilian government, which seeks to reverse the decision through a new appeal. AGU highlights that the country has the right to request the extradition of its citizens to respond for the crimes they are accused.

The maintenance of the negative by Spanish justice reinforces the understanding that the process has sensitive aspects, involving political and individual rights issues. The Brazilian government now needs to present new arguments that may convince the Spanish authorities to reconsider the decision.
