Deputy is accused of invading a system of the National Council of Justice with Walter Delgatti; Moraes proposed loss of mandate and ineligibility for 8 years
The 1st class of the Supreme Court (STF) unanimously sentenced to the federal deputy (PL-SP) to 10 years in prison. Minister Luiz Fux was the last to vote and accompanied this Wednesday (14.MAI.2025) the vote of the rapporteur ,.
The collegiate analyzes the criminal action in which the congressman and the hacker of the “leak jet”, Walter Delgatti Neto, are defendants for the crimes of invasion of the CNJ (National Council of Justice) system and ideological falsehood.
Moraes, Fux, Flávio Dino, Cristiano Zanin and Cármen Lúcia voted in favor of conviction. The analysis is done in the virtual plenary of the court. It runs until May 16th. After the trial, the defenses can still appeal.
According to the prosecution of the PGR (Attorney General’s Office), the congressman commanded the invasion of the council system to issue an arrest warrant to Moraes, as if he was determining his own arrest.
The rapporteur voted for the loss of Zambelli’s mandate, which should be declared by the Board of Directors of the Chamber of Deputies. He also determined ineligibility of the congressman for 8 years.
Even ineligible, Zambelli will only lose his mandate when there is no more appeal.
The congressman and Delgatti, who has been sentenced to 8 years and 3 months in prison, will still have $ 2 million in compensation for collective material and moral damages. The amount must be destined to a fund managed by a Federal Council or state councils of the Public Prosecution Service to reconstruct the injured goods.

In a statement at the CPI (Parliamentary Commission of Inquiry) of 8 January, which brought together deputies and senators, in August 2023, the hacker that the request for attack on the site had been made by the deputy. He also stated that the former president (PL) was amnesty if he committed any illicit.

What Zambelli says
In a statement, the deputy claimed to be the victim of political persecution and that there is no concrete evidence. This is the full statement:
“With respect to the Brazilian population and the confidence that almost 1 million voters deposited in me, I come to express my deepest sense of nonconformity in the face of the vote given by Minister Alexandre de Moraes this morning, who, ignoring the facts and the absence of evidence in the file, chose to unjustly condemn me.
“I am being the victim of political persecution that is not only against my personal honor, but also against the most elementary principles of the rule of law. What is on trial are not concrete actions, but my firm stance, active voice and my unwavering defense of the conservative values I represent.
“I repeat: there is no proof that sustains this conviction. What exists is a clear attempt to silence a right -wing woman, deputy elected by the people, who does not bow to abuses of power.
“I follow with a quiet conscience, because I never acted with deceit, violence or bad faith, and never committed any criminal act punishable by Brazilian law.
“Despite the pain of seeing earthly justice fails, my faith remains unshakable. I fully trust in God’s righteousness – sovereign, straight and incorruptible. He knows my heart and knows the truth that I support.
“My only source of income is the salary of my work as a deputy. An honest politician, who lives from his own salary, would never have resources to pay a dismissed fine that exceeds $ 4.5 million, referring to the two ongoing judgments in court. This is something that goes beyond any reasonable limit.
“I thank the support I have received from so many people who understand that this process goes beyond legal boundaries and enters the dangerous territory of ideological persecution.
“I will continue to stand, never abandoning the principles that have brought me here.
“It only ends when God says it is over. The truth will prevail”.
