Unanimously, the first class of the Federal Supreme Court (STF) rejected on Thursday (15) the appeals of the defense of former Minister and General Walter Braga Netto, who contested the exhibition of videos of the acts of 8 January 2023 by Minister Alexandre de Moraes during the military judgment.
In March, during the trial session that analyzed the complaint of the Attorney General’s Office (PGR) against Braga Netto and seven other defendants, including former President Jair Bolsonaro (PL), Moraes showed videos of attacks on the headquarters of the three powers.
For the minister, the videos remembered the severity of the acts, showing that they were not peaceful, but an “attempt to coup d’état violent, with fire, destruction of public heritage, qualified damage.”
For Braga Netto lawyers, however, the videos should not be used as evidence because it is facts unrelated to the complaint. The argument was contested by Moraes.
“Considering that the content of the videos presented in a trial session is a public and notorious fact, as well as being covered by the description of the complaint, I reject the defensive allegation,” the minister said in vote.
In the same appeal, Braga Netto’s defense also requested the cancellation of Lieutenant Colonel Mauro Cid’s denunciation, access to all evidence that make up the investigation and questioned the admissibility of the complaint.
All requests were rejected by Moraes, who argued that the themes had already been deliberated by the first class. Ministers Cristiano Zanin, Flávio Dino, Luiz Fux and Cármen Lúcia accompanied the rapporteur.
