The defense of the hairdresser Débora Rodrigues dos Santos filed an appeal on Wednesday, 14, against his conviction by the Supreme Federal Court (STF), related to the scammer acts of 8 January. Deborah became known after writing, with lipstick, the phrase “lost, Mané” in the sculpture “The Justice”, located in front of the STF.
“The applicant’s confession assisted in the grounds of his conviction, but was not considered due to the attenuation of the penalty, which is why the attenuating must be considered”, appears in the appeal. The lawyers argue that the confession made by Deborah was not considered in setting the sentence, stipulated in 14 years in prison.
Deborah has been under house arrest since March, by decision of Minister Alexandre de Moraes. She was unanimously condemned by the First Class of the Supreme Court, although the ministers diverged about the dosimetry of the penalty. The rapporteur of the case, Minister Alexandre de Moraes, proposed the penalty of 14 years, being followed by Flávio Dino and Cármen Lúcia. Already Cristiano Zanin defended a penalty of 11 years, while Luiz Fux voted for a shorter period: one year and six months. The trial ended in April.

The defense requests the permanence of Deborah in house arrest, supporting themselves in article 117 of the Law of Criminal Executions, which allows this modality of serving a penalty for women with minors. Lawyers say Deborah is the mother of two children who “are totally dependent on their care.”
The appeal filed is a declaration embargo, a legal instrument used to clarify any omissions, contradictions, obscurities or doubts present in court decisions.
After being detained and identified, Deborah wrote a letter to Minister Alexandre de Moraes, in which he apologized for graffiti in the statue. In the document, she states that she was unaware of the symbolic and historical value of the work.

Deborah was held responsible for five crimes: armed criminal association, attempted violent abolition of the rule of law, coup, qualified damage and deterioration of listed heritage, all linked to acts of vandalism that occurred in the invasion of the headquarters of the three powers.
