Lawyers resort to alternative strategies to ensure that deponents participate in the Supreme sessions for testimonials.
The effort, however, bumps into listed witnesses who do not want to attend the hearings. Without personal subpoena, the presence is not mandatory.
The STF minister has adopted as a practice in the proceedings related to the attempted coup d’état the subpoena only of the prosecution witnesses.
Supreme ministers recognize that the procedure is not the most conventional, but they evaluate it is a valid antidote against defenses trying to drag the processes for long periods, including witnesses who have no direct relationship with the case.
In the case against the central core of the coup, Moraes only sent a letter to the heads of civil and military servers listed as witnesses. The document informs the date and time of the hearing and asks for the release of the civil servant to the hearing, without requiring the participation of the indicated person.
To circumvent the problem, the defense of former Navy Chief Almir Garnier decided to notify witnesses listed by a warning of receipt-a lawyers used so that a person outside the case will be notified of court decision.
Garnier listed four people as witnesses. The list includes the current Navy commander, Admiral Marcos Sampaio Olsen, and former Defense Minister Aldo Rebelo.
The defense of the former president () decided to talk to each of the names indicated to ask them to participate in the hearings. It is difficult, however, to ensure the participation of some people, such as former TSE secretary Giuseppe Janino and the Air Force Colonel Wagner de Oliveira, one of the members of the Armed Forces Group who supervised the ballot boxes.
Faced with the difficulty of gathering all witnesses to the testimony, lawyer Celso Vilardi asked Moraes to change the procedure. He says the Code of Criminal Procedure defines that civil servants must be summoned to the hearings.
“The reconsideration or reform of the aggravated decision is required so that the rule of Article 221 of the Code of Criminal Procedure is effective and fully complied with, as it is the prerogative of the witness and not the defendant or the defense,” he says.
Bolsonaro’s defense also calls for the postponement of the beginning of the testimonies. She claims that the Federal Police did not give access to all evidence gathered during the investigation. It would be unfeasible, according to Vilardi, to prepare questions for the interrogations without having access to all seized files.
The most complex case involves the former Minister of Justice. The defendant’s defense indicated 36 witnesses, many of whom are not even contacting or has troubled relationship.
Lawyer Eumar Novacki, defender of the former minister, says he has not yet made contact with each indicated witness. “This ‘innovation’ will undoubtedly bring damage to the defense,” says Moraes procedure of non -subpoena.
The accusation and the defenses summoned 82 witnesses to be heard by the Supreme in the coup plot process. The audiences start on Monday (19) and should last two weeks.
More than one third (31) of the witnesses is composed of military of the Armed Forces. The large number of listed officers created doubts about the decision of the military summits about the release of the military to the hearings.
Two general officers told the Sheet that the army was informed by the Supreme about the list of military listed as witnesses. In the case of officers and squares indicated by the defenses, the force will release the servers on the day and time provided for the testimony.
There is no specific orientation of the Army Command for the military attendance in the statement. It will be up to each military to decide whether or not to participate in the Supreme Hearing.
