Bolsonaro asks the Supreme Court to postpone prosecution hearings

Defense of the former president claims to Moraes that there was no time to download and analyze the evidence delivered by the PF

The defense of the former president (PL) requested this Friday (16.MAI.2025) to Minister Alexandre de Moraes, of the Supreme Court (Supreme Court), the postponement of the testimony in the case of after the 2022 elections. The hearing of witnesses are scheduled to start on Monday (19.MAI) and should last by the end of the month.

Bolsonaro lawyers say the complete analysis of the evidence is unfeasible within the current time and starting hearings before that compromises the right of defense. Read the request sent to the Court Rapporteur (PDF – 931 KB).

According to the defense, the PF (Federal Police) sent, on May 14 and 15, 3 links with documents that total almost 40 terabytes of data. The material was sent.

It argues that data volume requires time to be downloaded and analyzed. “Considering a 500 mbps internet speed, only the compacted files would take almost 178 hours of uninterrupted work”says.

Bolsonaro lawyers also mention that, even before receiving the complaint, they had already requested access to the integrality of the evidence – and not only to the sections selected by the PF and used by the MP (Public Prosecution Service).

The postponement request has not yet been analyzed by Moraes. And that Bolsonaro’s defense tries to postpone the testimonials.

In all, 82 witnesses must be heard. Among the names are former commanders of the Armed Forces Marco Antonio Freire Gomes (Army) and Carlos de Almeida Baptista Júnior (Aeronautics), as well as the governor of São Paulo, (Republicans).

The case judges the participation of “Núcleo Crucial”which will be heard initially, and is pointed out as responsible for articulating the alleged coup attempt.

The criminal action against the group was initiated and is in the procedural instruction phase, when testimonials are collected from the witnesses indicated by the parties and the evidence is presented. The hearing runs until June 2nd.
