Decision prevents Trump from using a standard of war times to expel immigrants accused of integrating criminal group
The Supreme Court of the United States decided, this Friday (16.MAI.2025), to maintain the suspension of the use of Foreign Enemies Law by President Donald Trump to deport Venezuelan immigrants.
The measure temporarily prevents the government to use a 18th century law, created for times of war, to expel from the country Venezuelans accused of integrating the criminal faction Aragua train. The case will be reevaluated by a lower court.
Meanwhile, immigrants cannot be deported. They will be entitled to stay in the United States until their processes are completed, with the possibility of resorting to the Supreme Court again.
Next Steps
The 5th Circuit Appeals Court will have to analyze 2 main points:
- If Venezuelans can, in fact, be deported based on the law;
- What kind of warning the government should give before deportation so that immigrants have a chance to appeal.
