The Penal Code already establishes greater punishment for crimes against people aged 70 or older; Project wants to download to 60 years

The bill wants to reduce from 70 years to 60 years to the age from which the addition of a penalty of 1/3 to double is applied when the crime of estelionate is committed against elderly or vulnerable.

“Currently, the Penal Code establishes this protection only for people aged 70 or older, but Brazilian law already recognizes as elderly who is 60 or older, according to the Elderly Statute.”says the deputy.

“Considering that people from the age of 60 are often more vulnerable to financial fraud and blows, it is essential to adapt the criminal legislation to ensure greater protection to this portion of the population.”adds Ely Santos.

Next Steps

The proposal will be analyzed by the committees of defense of the rights of the elderly; and constitution and justice and citizenship. It will then be voted by the plenary. To become law, the text needs to be approved by the House and the Senate.
