Entities and interested in attending the hearing will have to register, until the 10th of the month coming with the Federal Supreme Court
The Minister of the Supreme Court (STF) determined the holding of a public hearing on June 27 on PIX amendments and bench amendments – considered the estate of the secret budget. The minister wants to hear “technically qualified and specialized” arguments that can support the court in the analysis of actions that question such amendments. The processes question not only the transparency and traceability of amendments, but their very validity.
“The theme of parliamentary amendments and their imposition is undeniable relevance from the social, economic and legal point of view. This is a discussion that involves the interpretation of the postulate of the separation of powers-the fundamental principle of the republic and the stone clause-as well as the fundamental right to the due budget process and the set of norms that make up the so-called“ financial constitution ”, the minister signed on Sunday warned”, noted on Sunday (18).
The hearing will be held with the support of the Conflict Consensual Solution Centers (nusol) and STF Structural Processes (Nupe), between 9 am and 17 hours on June 27. Entities and interested in attending the hearing will have to register, until the 10th of next month with the Supreme Court. On June 12 will be published the list of participants admitted to the hearing. Dino has already issued invitations to the parts of the actions: The Authors-PSOL, the Attorney General’s Office and the Brazilian Association of Investigative Journalism (Abraji); activated – the tables of the Chamber of Deputies and the Federal Senate; and friends of the court, entities that accompany the process, such as Transparency Brazil and International Transparency Brazil.
The minister also determined that hearing was made to a series of authorities and entities: the president of the Chamber of Deputies, Hugo Motta (Republicans-PB); Senate President David Alcolumbre (Union-AP); the attorney general of the Union, Jorge Messias; Planning and Budget Minister Simone Tebet; Minister of the Secretariat of Institutional Relations, Gleisi Hoffman; the President of the Federal Court of Audit, Vital do Rêgo Filho; the head of the Comptroller General of the Union, Vinicius Marques de Carvalho; the Governors Forum, to the National Confederation of Municipalities (CNM); and the National Front of Mayors and Mayors (FNP).
Dino stressed that, in hearings, reports should not be discussed, imputations of misconduct and cases of deviations from public resources – issues that are the subject of inquiries. “The public hearing in the Supreme Court will deal exclusively on constitutional controversies and reflections on possible decisions in abstract control actions already filed,” said Dino. In his latest decision on amendments, Dino showed a “retreat.” The minister validated a resolution approved by the House that created what was called the leader amendment, which allows commission amendments to be analyzed in each collegiate from the indications made by party leaders, hiding the name of the true applicants.
