O Court of Justice of the State of Paraná (TJPR) instituted a Heteroidentification Commission for entrance contests in judiciary. The measure aims to ensure that there is no misrepresentation of the policy of racial quotas.
The Commission, based on Lei N.º 12990/2014 by Resolution No. 541/2023 of the National Council of Justice (CNJ), will act in National Examination of the Judiciary (ENAM) and no National Examination of the Notary’s Offices (ENAC).
The racial condition identification process occurs in two steps. First, the candidate self -declarationclaiming to be a black or brown person.
Then the Heteroidentification Commission performs an evaluation phenotypican anthropological examination to verify that the candidate, due to his physical characteristics, could be the target of racial discrimination.
CNJ creates scholarship to increase blacks in the judiciary
O. In addition, the agency has instituted a scholarship program for those approved in the National Judiciary Exam (ENAM), which is a prerequisite to apply for judge competitions.
Currently, about 15% of Brazilian judges identify themselves as black or brown, according to a survey conducted by the CNJ itself. This percentage is considered low when compared to the demographic composition of Brazil.
The scholarship program, developed in collaboration with the FGV Law Racial and Law Center, initially offered 100 aid in the amount of R $ 3,000 monthly, lasting up to twelve months. The number of people benefited depends on the budget availability of the financial fund created by the program, which has donations from private entities.
