Moraes denies Bolsonaro's request and maintains audiences in the case of the alleged scammers

Minister Alexandre de Moraes of the Federal Supreme Court (STF) rejected the request for the defense of former President Jair Bolsonaro (PL) to postpone the hearings of the process that investigates an alleged attempted coup.

The defense of the former president claimed that he would not have had a timely time to exist the new evidence, sent by the Federal Police (PF) in three links that total about 40 terabytes of data. The lawyers reported that the size of the material makes proper analysis of the testimonials impossible before the date, and requested the suspension of hearings to guarantee the right to broad defense.

In the decision, Moraes stated that the new material does not change the facts already presented by the Attorney General’s Office (PGR) and that they supported the complaint accepted by the Supreme Court.

“The availability of this material, however, in no way altered the facts imputed in the prosecution, embodied in the complaint offered by the Public Prosecution Service and the probative set in which it was based and that, at first, they were analyzed by the judiciary in a session of receipt of the complaint and whose probative instruction will start with the hearing for the hearing of the witnesses indicated,” wrote the STF minister.

Hearings maintained from Monday (19)

This follows the witness hearings, which start on Monday (19). Among the first to testify are OSEx-commanders of the Armed Forces Marco Antônio Freire Gomes (Army) and Carlos Baptista Júnior (Aeronautics), as well as the governor of the Federal District, Ibaneis Rocha (MDB). According to statements to the Federal Police, Bolsonaro would have presented to these military proposals to reverse the result of the 2022 elections.

On the 22nd, it will be the turn of the witnesses indicated by Mauro Cid, former Assistant of Orders of Bolsonaro and whistleblower in the case. Among them is the former army commander Júlio Cesar de Arruda, who assumed the position already in the government Luiz Inacio Lula da Silva (PT).

Supporters of São Paulo, Tarcísio de Freitas, former Minister Paulo Guedes and senators Hamilton Mourão (Republicans-RS), Ciro Nogueira (PP-PI) and Rogério Marinho (PL-RN), all allies and former members of the Bolsonaro government.

Bolsonaro is a defendant in the Supreme Court on charges of leading an attempt to coup to prevent the inauguration of President -elect Luiz Inacio Lula da Silva (PT).
