Moraes denies Bolsonaro’s request to postpone hearings

Defense of the former president said it was impossible to analyze all evidence within the current period; hearings start on Monday (19.mai)

Minister Alexandre de Moraes of the (Supreme Federal Court) denied on Saturday (17.MAI.2025) the defense of the former president (PL) to postpone the testimonies in the investigation that investigates the attempted coup after the 2022 elections. Here is the decision (PDF-138 kb).

In the request, the lawyers had claimed that the complete analysis of the evidence is unfeasible within the current period and that starting the hearings before that compromises the right of defense. Witness hearing are scheduled to start on Monday (19.MAI) and should extend until the end of the month.

According to the defense, the PF (Federal Police) sent, on May 14 and 15, 3 links with documents that total almost 40 terabytes of data. The material at the request of the rapporteur of the case.

In the decision, however, Moraes says that the release of the content does not change the progress of the process or the content of the prosecution presented by the PGR (Attorney General’s Office).

“The availability of this material, however, in no way altered the facts imputed in the prosecution, embodied in the complaint offered by the Public Prosecution Service and the probationary set in which it was based and that, in a 1st moment, they were analyzed by the Judiciary in a session of receipt of the complaint and whose probative instruction will begin with the hearing for the hearing of the witnesses indicated.”says an excerpt from the decision.

The hearings will be performed by video conferencing. There will be no official transmission, but the press – National and International – may follow the testimonials through a big screen installed in the 1st class room of the STF. Still, accredited journalists will be prohibited from making any type of recording.
