The letter targets J&T Express Brasil, subsidiary of an Indonesian company, which was the subject of a representation of Abraed (Brazilian Association of Distribution Companies) in Cade. The agency, however, filed the request.

In the document, sent to the Secretariat of Economic Monitoring, the Post Office ask Cade to reconsider the decision.

“The representation brought together reports of small businesses that were unilaterally excluded from the market due to supposedly fraudulent conducts from J&T,” says the letter. “J&T adopts pricing policy that results in a negative margin of more than 40%, demonstrating the clear operational unsustainability of the business, when provided on competitive conditions.”

In the letter, the state -owned company asks the Secretariat to elaborate a representation to Cade recommending the immediate establishment of administrative proceedings against J&T and other companies that work similarly in the market.

“Performance is essential to contain predatory practices and signal to the market that similar actions cannot be tolerated,” he concludes.

The panel sought J&T through the email available on the company’s website, but got no return.
