‘Get down to BC’: Rules for Rio’s Orla used as Balneário Camboriú inspiration

The decree of Eduardo Paes (PSD), which prohibits ambient and live music in the waterfront kiosks, among 15 other restrictions, caused a strong reaction. This Tuesday, in the City Council, in a public hearing marked even before the publication of the decree, to discuss Bill 488, of 2025, which establishes the Statute of the Orla, councilors of the base and opposition criticized the rigor of the measures determined by the mayor.

This measure – disassociated from the decree – is inspired by the waterfront of Balneário Camboriú, as admitted by Councilman Flavio Valle (PSD), author of the project. The measures of the city of Santa Catarina, however, are widely criticized by geographers.

The Orla Statute proposes, among other measures, rainfall standardization, installation of hydration points, bike racks, restoration of stairs and handrails and increasing the sand strip of Ipanema and Leblon.

– Rio has a unique lifestyle, and any regulation must respect this spontaneity and cultural vibration. Music, gastronomic plurality and the occupation of the waterfront are part of the carioca experience. Statute seeks a balanced order. I am in direct dialogue with the mayor so that we can adjust – said Valle, who is also chairman of the Tourism Commission and was in favor of adjustments to the Executive’s proposal

At Pedro Ernesto Palace, the discussion had a high quorum. Carlo Caiado, Mayor of the City Council, to dozens of boatmen, was unanimous the opinion that the decree needs to be reviewed. The measures determined by Paes were also the subject of protest of traders, contrary to the replacement of the names of the numbers, another of the new rules.

Parallel to the extent of the executive and the discussion of parliamentarians, an action of the Federal Public Prosecution Service calls for the demolition of kiosks that irregularly occupy sand bands in the river, which draws attention to the urgency of planning on the beaches.

In court

Still on the decree of Paes, on Tuesday, the Brazilian Institute of Citizenship (Ibrac) filed a court with a public civil action asking for the suspension of articles that see the performance of music in the kiosks, claiming that the measure compromises the free exercise of economic activity. Sought, the city reported that it has not yet been notified of the action.

Leonardo Bessa, a musician who works in kiosks such as Samba Social Club, regretted the early publication of the decree which, according to him, financially harms the artists. At the House hearing, musicians who work on the waterfront, all in black, made protests. In posters and when chanting the samba, they asked, “Don’t let samba die.”

– During the pandemic, the class of musicians was the one that suffered the most. And to this day, in any sound -related problem, the musician is guilty. This affects us financially and culturally. We fight day by day to take bread home. The waterfront is a big stage. We have a great possibility for our work, to feed our families. Musicians need to work. A week already has a great impact on our daily lives. This decree was released without anyone being heard, ”said Bessa.

At the meeting, the article of the decree that replaces the names of the tents by numbers and determines the removal of their flags was also criticized. Present councilors, such as Talita Galhardo (PSDB), and registered representatives criticized the measure, which according to them goes against a cultural identity of Rio. In the podium, protesters held posters with the words “We are not just numbers” and “We are point of reference, security base in the largest tourist asset in Rio de Janeiro”.
