Single candidate in the election that will define the new president of CBF (Brazilian Football Confederation) next Sunday (25), Samir Xaud, 41, was the target of labor lawsuits in Boa Vista and even had the assets blocked due to labor debts of a company of which he was a partner, a furniture store in the capital of Roraima.
The actions, to which the Sheet He had access, proceeded mainly in 2016 and 2017 and resulted in the payment for Xaud, upon agreement, at least $ 24,000 after the court determined blocking vehicles and real estate and seeking bank balances in his name.
The exchange of command at CBF occurs after Ednaldo Rodrigues’ removal by the Rio de Janeiro Court of Justice. The former president is suspected of having benefited from the use of a false signature in an agreement aimed at ending internal disputes in the entity. He gave up on the suspension.
In the five lawsuits, Difratelli Móveis staff state that salaries and proportional amounts of termination (such as vacation and 13th salary) were not fully paid and also report the collection of FGTS (Service Time Guarantee Fund) and retention of work portfolios.
In one case, a former employee said he was received with shouts and curses when he was charging the amount due in 2016, when in theory the new president of CBF was no longer partner of the company.
In the actions, Xaud argued that he had already sold the furniture company when the lawsuits were filed, but the court did not accept the demonstration arguing that employees were hired when he was still a partner and listing articles of the Civil Code and the CLT (consolidation of labor laws) on joint liability in relation to labor debts.
The law states that members who are in the process of leaving the company respond to the company’s labor obligations regarding the period in which they appeared as partners in lawsuits up to two years after the change in the contract.
The court tried in all cases to notify and charge the debts of new members, but did not find assets or bank balances. With this, he made the charge and blockages regarding Xaud and his wife, Natália, also former partner of the company.
In a note sent to Sheetthe future president of the CBF said that “it is unaware of any labor proceedings in which it has failed legal obligations or judicial decisions” and that “it has always acted regularly, both in the public and private sphere, fully fulfilling its legal, tax and labor duties.”
In the text, he also “reaffirms his commitment to ethics, legality and transparency in all areas of his performance”.
In one case, a designer and the three partners of the company (including Xaud and his wife, Natália) came to an agreement, which was then approved by the Labor Court.
Two months later, in January 2017, the professional told court that the deal was not being met and no payment of the right installments had been made.
The payment of R $ 9,400 to the designer happened from the attachment of amounts in Bank Accounts of Xaud and his wife.
In one case, one of the judges states that the reports indicate that the company was abandoned by the partners, who did not respond to the subpoenas of justice.
For the documents, Xaud and his wife were the only members of the company from 2013 to 2016.
The future president CBF is a doctor. He was elected to the command of Roraima football recently, to the place of his own father, Zeca Xaud, president of the Roraimense entity since the 1980s. His mandate would begin in 2027.
He was the first to sign up for the dispute that takes place on Sunday (25), with the support of 25 federations and 10 clubs.
Reinaldo Carneiro Bastos, president of the Paulista Football Federation, tried to launch candidacy and got support from 32 clubs, but CBF rules require the endorsement of at least eight state federations for registration. As Xaud got support from 25 of the 27 federations-in which São Paulo and Mato Grosso were left out-any other candidacy became impossible.
Since the name of Xaud was a favorite of Ednaldo’s succession, they have surfaced in the press several reports reporting complaints and irregularities.
UOL report showed that Xaud tried to regularize land in Roraima located in an environmental area. He denies the owner of the property.
The Globo newspaper, in turn, revealed that he would have been suspended for two years of the role of medical expert of the Court of Justice of his state for medical error. Xaud would have only expected the arm of a motorcyclist who requested compulsory insurance compensation (DPVAT) for permanent leg injury. He denies that the failure has happened.
Reporting of The State of S. Paulo showed that Xaud responds to a lawsuit for administrative misconduct, relating to the time when he was director general of the Roraima General Hospital, from 2017 to 2020. He and six other managers would simulate services to justify payments to a company, causing loss of $ 1.4 million to public coffers. He states that the process does not show any evidence of irregularity on his part.
