The Secretary of State of, Marco Rubio, said on Wednesday (21) that the Minister of the Supreme Federal Court may suffer sanctions in the country.
The head of American diplomacy said, at an audience at the Foreign Relations Commission of the Chamber of Representatives of the country, that the government analyzes the possible punishment. It is the first time that one to the Brazilian magistrate.
“It is under analysis at this time and there is a great possibility of happening,” he said.
The opposition came to say that Moraes’s decisions would surround the freedom of expression, which motivated appeals for international sanctions.
The magnitsky law, which allows the unilateral application of punishments to foreigners accused of seriousness or systematic violations, has been pointed out by critics of Moraes as a possible legal basis against the minister.
Possible sanctions include the blockade of goods on American soil, the freezing of accounts and the prohibition of entry into the country. There is no need for judicial proceedings – a basis for a decision of the Executive based on reports or documents from international organizations, and testimonies.
The STF’s advisory denied that Moraes has accounts or assets in the US. The measure, however, could reach his accounts on Brazilian banks that operate in American lands, as well as credit card flags.
Sanctions may be imposed based on non -judicial evidence, but need plausible grounds. They apply to those responsible for extrajudicial executions, torture, arbitrary arrests, forced disappearances and other flagrant violations of the rights to life, freedom and security, according to the text of American legislation itself.
The definition of “serious violations” is anchored in international treaties and requires systematic conduct. Agents may also be punished who repress allegations of corruption or prevent the work of journalists and rights advocates.
Moraes has been the target of US government pressures. In February, already under Donald Trump, the State Department released one to the magistrate’s determination to, used by right -wing influencers.
“Respect for sovereignty is a two -way road with all US partners, including Brazil,” the agency said.
“Blocking access to information and imposing fines on US -based companies for refusing to censor people living in the United States is incompatible with democratic values, including freedom of expression,” the text said.
The federal deputy licensed (-SP) also and with members of the White House, to apply the sanction to the minister. The subject was mentioned at the end of February in social network interaction between the –Radicated in the US and also the target of Moraes – and the businessman, now advisor to the US President.
