The Court of Instruction number 3 of Madrid has charged two high positions of the Community of Madrid that will be interrogated on Monday by their role in 2020, as two family associations have reported in a press release. Carlos Mur and Javier Peromingo were key actors in the elaboration of protocols that ruled out the hospitalization of sick elderly. It is the first time after five years of judicial investigation that a high position is charged by the Executive of Isabel Díaz Ayuso, which families also accuse for what happened.
Mur was in March 2020 the Director of Socio -health coordination, the position of the Ministry of Health responsible for assistance to the 474 residences of higher active in the region. Javier Peromingo was the geriatrics of the Rey Juan Carlos Hospital, in Móstoles, and was the doctor who coordinated with Mur to elaborate the protocols for those centers. In May, when Mur was dismissed, he held his post.
The two worked for weeks on a draft, at least since March 13, 2020, and Mur ended up signing four versions that were sent to the hierarchical superiors of this in the Ministry of Health, then directed by Enrique Ruiz Escudero, in addition to the hospitals responsible for executing that triage. The versions were distributed on March 18, 20, 24 and 25.
In essence the four documents ruled out people with dependencies for their day to day, whether physical or mental, and recommended that they be treated in the residence itself. In theory, a medical reinforcement of the 474 residences was going to be produced, as Escudero had announced on March 12. However, in practice, the virus devastated those centers, including its low health personnel. Ayuso said that hundreds of residences had “medicalized”, but the truth is that those responsible for the residences employers denied him, in addition to the advisor of his government responsible for those centers, Alberto Reyero.
Until now, Mur and Perombo had declared witnesses in different courts, but no judge had taken this step. The investigation was fragmented in 2020 in a multitude of judicial organs, depending on the place where the residences of the deceased were.
The imputation of both has occurred within the framework of a new complaint of the families, which was presented by the Prosecutor’s Office last month, about that the prescription period of five years was fulfilled. In this new judicial action, families have asked judges to investigate a new crime, the denial of a public service, health care. Since 2020, they had been complained about a series of crimes that had not prospered: homicide, relief omission or prevarication.
The press release, of 7291: truth and justice and tide of residences, has been disseminated on Friday morning. The two associations have starred during these five years Judicial Battle of hundreds of relatives, to whom they have lent legal advice.
“Both entities are convinced that criminal and political responsibility does not stop in Mur and Peromingo,” says the press release. “Therefore, although as investigated they are not obliged to tell the truth, we ask them to tell that truth and reveal what the involvement of the then Minister of Health – Enrique Ruiz Escudero – and of the ayuso itself in the decisions adopted by the regional government that had a brutal impact on the lives of many residents.”
