The proposal of amendment to the Constitution that was approved on Wednesday (21) in the Constitution and Justice Commission, but is resistance in both houses, which makes its final approval uncertain.

Although the end of reelection to president, governors and mayors have support between congressmen, a part of them criticizes the confusing transition rules and the unification of all elections in a single year, which will force the citizen to choose nine candidates at once, in a campaign that will mix municipal, state and federal subjects.

The measure proposes a gradual and complex transition until 2039, when all mandates will last five years. The way to this standardization, however, includes a series of terms with variable durations (four, five, six, eight and nine years old), according to positions and election years.

The text approved by the Commission needs to be voted in the plenary in two shifts and then analyzed in the House.

In the case of mayors, for example: currents have a four -year term. The elected in 2028 would have a six -year term, two more. From then on, five years.

Senators, in turn, would keep the current eight -year terms in 2026. By 2030, the elected would have an exceptional term of nine years and, in 2034, five, which would create, from 2034, a coexistence between parliamentarians with distinct deadlines – some five years in office, others with nine.

Today the house renews chairs every four years, one third in one election and two thirds in another.

In the case of reelection, by the project, the modality is allowed in 2026, for presidents and governors, and in 2028 for mayors. After that, it is prohibited.

The Senate President, (-AP), met with party leaders on Thursday (22) and, according to reports, assured the PEC vote in plenary next week.

The day before, he publicly said that he would defend the immediate vote.

“The vote today [quarta] It reflects the Senate’s desire to give a new direction to the electoral process, regarding the majority elections in Brazil and, of course, the coincidence of the elections. I think it will be, with absolute certainty, the deepest change in Brazil’s electoral framework in recent years, “said Alcolumbre.

“I have all the desire and interest that next week, this proposal is in deliberation in the Federal Senate Plenary. I want to hear the party leaders and I am absolutely sure that most will support this decision,” he added.

Some senators criticized behind the scenes, claiming not to support a five -year term from 2034 to some and from 2039 to all. The reduction of mandates in three years from this date is not well regarded by most of them.

An alternative proposal would be to expand the mandates of senators from eight to ten years, which could generate resistance in public opinion.

Already among deputies, despite the increase of one year within four years of office, the unification of all disputes – mayor, councilman, state, federal deputy, senator, governor and president – in a single year is not well regarded among some.

If this happens, the voter will have to choose nine names at once: councilman, mayor, state deputy, governor, three candidates for the Senate, Federal Deputy and President of the Republic.

To be approved in the Senate Plenary, it takes the support of at least 49 of the 81 senators in two voting shifts. If it passes, the PEC must be processed in the House by the CCJ, special commission and then plenary. It takes the vote of at least 308 of the 513 deputies.

The proposal came out of the senators’ drawer after the House approved, rejecting an equation that only remodels the current vacancies according to the new data of Census 2022. The text is under analysis in the Senate.

Understand the end of reelection and unification of elections

Mayors and councilors:

  • As it is today: four -year term, with the possibility of reelection for mayors and successive reelections for councilors

Senators:

  • As it is today: Eight -year -old mandates, with the possibility of successive reelection. Senate renewal occurs every four years, with one third and two thirds of the house entering each election

Governors and President of the Republic:

  • As it is today: four -year term, with the possibility of a reelection

ELECTION DATE

  • As it is today: They occur every two years, divided between municipal (mayors and councilors) and general (deputies, senators, governors and president)

  • How would it be: From 2034 they would be unified in a single year, occurring every five years.
