Assistants of the President () assess that any sanctions against the minister, (Supreme Federal Court), would represent an institutional attack by the government against Brazil, but are divided into how and when to react.

Possible punishments of the Trump government against Moraes have been on the radar for months, but they gained strength after a statement by the Secretary of State, Marco Rubio, on Wednesday (21), that there is a “great possibility” of such measures to be adopted.

Rubio’s speech, the head of American diplomacy, was seen by Lula’s allies as an interference from the US in an internal subject in Brazil. But there is no consensus on how to answer.

An wing of ministers and advisors believes it would not at the moment an official demonstration of the Planalto Palace or against the threats made by Rubio would not be.

They point out that entering the rhetorical fight would be to play the desired game by the Bolsonarist leaders who are encouraging US authorities to invest against Moraes-the federal deputy (PL-SP) has graduated from the mandate and moved to the US to defend punishments against the STF.

Moreover, the current geopolitical board is highly complex and does not matter to Brazil to get in shock with Trump management, members of this wing say.

To cite an example, the Lula government has opened negotiations with Washington to try to soften the impacts of the tariff imposed by Washington to important sectors of the economy, such as steel.

In this sense, it would be best to try to depolitize the bilateral relationship and only be directly involved in the dispute if any measure is effectively adopted.

This view, however, is not consensual among Lula’s assistants. There is a group that opines that the threat made by Rubio demands a political position of Brazil. Not answering, they say, strengthens the Bolsonarist speech that Moraes pursued oppositionists and practiced censorship in the country.

They also claim that the subject goes beyond the dynamics of the US relationships and has implications for Brazilian internal policy, especially for the involvement of pockets and the potential to be the theme of

This group also says that the Lula government needs to find a way to treat the offensive against Moraes as a threat to national sovereignty in an attempt to mobilize support from segments that do not necessarily identify with petism.

In this line, the publication on the social networks of a message by the Minister of Institutional Relations, (PT), was read by the president’s allies as a way to press for an official government reaction, especially Itamaraty.

“Bolsonaro’s conspiracy with the far right of the US is shameful, in search of foreign intervention in the Brazilian judiciary. The recent threat of the US Secretary of State for Minister Alexandre de Moraes deserves repudiation and highlights the defendant’s despair with the advancement of scammers’ trial,” he said.

During a hearing at the US Congress, Rubio said Moraes may suffer sanctions in the country and that the matter is “under analysis.” He was asked about it by a republican parliamentarian.

Congressmen aligned with Trump have been defending the use of the so -called magnitsky law to frame Moraes.

The standard, which refers to a Russian lawyer who died in a Moscow prison in 2012, allows the US government to adopt sanctions, including economic, against people who commit “large internationally recognized human rights violations.”

It is unclear what kind of measures the US would adopt against the STF minister, but they could involve the ban on entering the country, for example.

The PT bench in the House issued a note on Wednesday, which states that the case is an attempt by the US government to politicize court decisions.

“We reaffirm our repudiation of any attempt of external interference in internal matters of the country, especially when it comes to judicial decisions aimed at protecting the democratic rule of law,” the text says.

There was also involvement of the minister, of the Supreme Court. The magistrate stated on social network that it was not allowable for foreign agents to interfere with domestic matters.

“It cannot be assumed that foreign agents surround the exercise of domestic jurisdiction in the protection of constitutional guarantees. Normative autonomy represents imperative of democratic self -determination,” he said.

The STF dean argued that the regulation of digital platforms and the establishment of parameters for hate speeches would be a basic element of national sovereignty. “The Brazilian experience has shown in recent years that echo cameras and extremist demonstrations corrode the republican fundamentals,” he said.

The Minister of (Attorney General of the Union), Jorge Messias, shared Gilmar’s publication and posted a comment himself. According to him, the good coexistence between countries presupposes reciprocity.

Nacional issued a note from the entity’s Constitutional Studies Commission citing “concern and absolute repudiation in the face of any external initiative that aims to impose sanctions on Brazilian magistrates”.

“This is a clear violation of the principles of national sovereignty,” says the text, signed by Marcus Vinicius Furtado Coêlho, chairman of the commission.
