Professor Luciano Rigolo was sentenced to arrest by São Paulo justice for slander against Bolsonarist voters.

The targets of the publications filed a criminal complaint to the court stating that they were slandered. They said the accusations were unfounded and that the teacher had put his physical integrity at risk.
“Without any proof, he propagated offenses in the face of the honor of people who are their disaffections for free,” lawyer Janaína Lima told the court, who represents the aforementioned. “The unfair and willful public aggressions made by the teacher in the face of the wanting ones are untrue and criminal,” he said.
The defense of Rigolo told the court that “there was no intention on the part of the defendant of slander, defaming and injurious people cited, but to express his free manifestation of thought.”
He added that he spoke in a generic way, merely expressing a personal feeling after the acts of vandalism. “At no time did I say they were the perpetrators of the crime of terrorism. At no time did he say they were part of criminal organization.”
According to the defense, the demonstrations were held due to the political context of the occasion. “Admittedly, its dissatisfaction was genericly expressed, whose criticism is inserted in the exercise of freedom of expression, founded on political opinion, given the scenario experienced at the time of the facts.”
Judge Fernanda Yumi Hata did not accept the argument and condemned him to a penalty of 1 year, 4 months and 20 days of semi -open detention, and a fine of R $ 1,315.60.
In the semi -open regime, the convict is serving the penalty in the agricultural, industrial penalty colony or similar establishments, being able to work or study during the day, returning at night to the unit.
“Despite the defendant’s negative, there is no way to believe in his version, as there is material proof, namely the Prints of the Facebook social network that clearly and unambiguously demonstrate that he slandered the victims, behold, he called them scammers and terrorists, facts these criminals,” said the judge in the sentence. The teacher can still appeal.
