The big debate: Sanction to Moraes in the USA is justice or intervention?

Commentator José Eduardo Cardozo and businessman and former deputy Alexis Fonteyne discussed, on Thursday (22), in The Great Debate (Monday to Friday, at 11pm), if the possible sanction of the United States to Minister Alexandre de Moraes of the Supreme Court (STF) is fair or is an external intervention in Brazilian sovereignty.

The debate comes after US Secretary of State Marco Rubio to say in a session in the House of Representatives of the United States that there is a “great possibility” of Moraes to be punished based on magnitsky law, which allows to punish foreigners involved in human rights violations.

For Cardozo, the measure is a violence to the Brazilian state and needs to be rejected firmly.

“If Minister Moraes’s performance had any relationship with the United States, that’s fine. But there is no. If this is advancing, there will be a very strong international reaction. Otherwise, the United States will find themselves entitled to judge anything from any country. This is unacceptable from the point of view of international law.”

José Eduardo Cardozo stresses that it would be against the US sanction even if it had been taken against former President Jair Bolsonaro (PL).

“If he were sanctioned for trying a coup d’état, I would defend Brazilian sovereignty.”

For Alexis Fonteyne, the punishment to Moraes does not violate Brazilian sovereignty.

“The Magnitsky Law talks about human rights abuses, applied to any country. Alexandre de Moraes is not the sovereignty of Brazil and the minister has disrespected the laws and human rights. It is worth remembering that the whole process began when he sanctioned network X, which refused to promote prior censorship, which is not foreseen in our constitution.”

Alexis adds: “He [Moraes] He conducts a lawsuit in which he is allegedly the victim, the accuser, the judge, so he empowered himself in a way that he is not respecting anything else. So it is in this sense that the United States is using this law to block, within their territory, the resources that these person has. ”
