The São Paulo court denied the request for evidence made by the defense of Paulo Cupertino, accused of killing actor Rafael Miguel and his parents. Cupertino’s trial is scheduled for next Thursday (29).
The request was filed by the accused’s lawyer, Mirian Souza, on Friday (23). In the document, the defense asked about the crime of crime and the elaboration of the report of capsules and cartridges found at the crime scene, as well as the spray spray. In addition, the addition of possible security cameras images located in trades or homes near the site of the facts was also requested.
Judge Antonio Carlos Pontes de Souza, when denying the claims, said that the defendant should “bear his actions”, remembering that Paulo Cupertino dismissed the lawyers three times – one private and twice the public defender.
“It cannot be accepted is that the lawyer, now constituted, in this advanced phase of the process (which, repeated, must go forward,” pro cedere “to advance) and require, numerous times, to innovate in the probationary instruction, making the judgment on the appropriate date,” said the magistrate.
In the decision, the judge also pointed out that the date of the trial was set in 2024 and the requested steps would not have time to be fulfilled and were not even accepted by the judiciary.
After the rejection, Cupertino’s defense reiterated the request for evidence production on Friday (23) and stressed that they would have been made and filed in March 2025, just over two months before the scheduled date. The new request has not yet been tried.
Other requests
By the beginning of the week the court had already denied other requests made by the defense. The requests were for the trial to be closed, without press presence, use of civilian clothes, not use of handcuffs and replacing witnesses.
All requests were denied except the use of civilian clothing, which was accepted. Regarding the non -use of handcuffs, the judge determined that the assessment be made at the time of the trial by the police authority present.
Regarding the prohibition of the entry of the press, Judge Antonio Carlos Pontes de Souza stressed that the case is already public. “It is necessary to understand that the social and media repercussion is due to the quality of one of the victims, public person, actor, which will not change with procedural attitudes.”
Remember the case
The crime happened on June 9, 2019 and shocked the country. Cupertino was able to escape the authorities for three years, being captured only in May 2022 in an apartment in the south of São Paulo, after going through about 100 addresses in at least three countries – Brazil, Paraguay and Argentina.
According to the complaint of the Public Prosecution Service of São Paulo, Cupertino had an inauguration relationship with his daughter, Isabela Tibecherani Matias and did not accept that the young woman was related to the ex-actor of the children’s soap opera.
The documents in the case process indicate that on the date of the crime, Isabela went out to meet her boyfriend in a square near the house, in the neighborhood of Socorro, south of São Paulo.
When Cupertino came home and did not meet his daughter, spoke to his wife and demanded that she will come back. Following the order of the ex-husband, the teenager’s mother, Vanessa Tibcherani de Camargo, tried to call her daughter, but failed.
Following, the woman decided to call Rafael’s cell phone, but who answered was his mother, because he had forgotten his cell phone at home. After that, the former actor’s parents decided to take the phone to their son.
When they found the young couple, they also chose to take Isabela at home and take the opportunity to talk to Paulo Cupertino to ask for an approval of the couple’s dating.
The crime
According to Isabela’s report to the police, his father never accepted her relationship with Rafael. She said that at the time Cupertino learned of dating, “was very angry”, because it was always very possessive.
Isabela said that when Rafael’s parents went to leave her at home, Cupertino who attended the gate. He would have been harsh with the former-actor’s parents and asked her to enter, then closing the door.
At this moment, according to Isabela’s report, Miriam, Rafael’s mother, asked to talk. What happened following were several shots fired from Rafael and the parents. The expert has accounted for at least thirteen shots. Everyone died on the spot.
Carta
Cupertino sent a request from habeas corpus in a handwritten letter addressed to the court. Habeas Corpus’s request was considered and denied by the court, which did not recognize the allegations made by the defendant.
In the document, Paulo Cupertino asks for an impartial judge, as “every person accused of offense has the right to presume his innocence,” according to the letter.
“Well before my arrest I have been accused, massacred and persecuted in totally devoid and lying,“ aximos ”(sic) and assumptions,” says another passage. .
