Anyone who has cared for a deceased relative can be entitled to a higher part of the inheritance. A prerequisite for this “care enclosure” is, of course, that one can even speak of “care”. In practice, however, the definition of the term is not as easy as a current decision by the Supreme Court shows (OGH 29.4.2025, 2 Ob 33/25D).
