AGU asks the Supreme Court urgent measures against digital misinformation

Government body cites blows against retirees and pensioners injured by the INSS frauds and the case of the child who died after participating in a Tiktok challenge and aspiring deodorant

The (Attorney General of the Union) requested this Monday (26.MAI.2025) to (Supreme Federal Court) the immediate implementation of mechanisms to combat misinformation and digital violence on social networks.

The government agency cites blows against retirees and pensioners injured by the fraud at the INSS (National Institute of Social Security) and the case of the child who died after participating in a Tiktok challenge and aspiration deodorant.

The precautionary request for urgency is in the context of an appeal that discusses the civil liability of the companies that manage the platforms. As a judicial representative of the federal government, AGU figures as the main interested in the action.

Union Attorney General Jorge Messias argued that the platforms answer “civil and objectively when involved in the boosting, moderation or recommendation of illegal content“.

Still according to Messiah, the companies “They can also be responsible for allowing the performance of false or automated profiles, and must be liable jointly and severally with advertisers in cases of fraud, racism, violence against women and children, incitement to suicide, misuse of AI and electoral disinformation“.
