An analysis of the identified “significant discrepancies” in the financial movements of assistants working with ministers of the (Superior Court of Justice) and are investigated on suspicion of e.
The evaluation of the PF, presented in confidential documents obtained by the Sheetpoints suspicions in relation to three former advisors. In all cases, researchers say they have identified differences between information presented to revenue and bank movements.
One of the investigated is, who was chief of staff of Minister Isabel Gallotti. Another is Rodrigo Falcão de Oliveira Andrade, who headed the office of Minister Og Fernandes. Asked by SheetDaimler’s defense denied any irregularity in finance, that of Márcio Toledo said he would manifest himself in the file, and Rodrigo Falcão did not comment.
Inquiries on suspicions of decisions sales at the Court are supervised by the minister, (Supreme Court), and investigate the connection of advisors with, suspected of intermediating the negotiation of decisions.
Ministers are not investigated.
Daimler was quoted by Andreson in dialogues obtained by the PF. In conversations with third parties, the lobbyist talks about money from the then -chief of staff. The investigation has not so far pointed out direct conversations between the two.
Falcão is suspected of having leaked information about another decision sales operation,, about the Bahia Court of Justice.
Toledo, in turn, is investigated for movements made in processes “with alteration and exclusion of internal drafts within minutes, making visualization by others,” according to Zanin’s decision.
Sought, ministers Isabel Gallotti and Nancy Andrighi said they do not speak “about the facts and behaviors of third parties investigated by the Federal Supreme Court.” Og Fernandes did not respond.
The Federal Police document on the investigated deals with data from 2019 to 2023.
Regarding Daimler and Rodrigo, he states that the discrepancy between the informed revenues and the amounts moved to credit in their accounts “may indicate the occurrence of omission of revenues or the realization of transactions not reported in tax statements.”
“The biggest mismatch was verified in 2023, when the financial movement reached twice the revenue declared in its year,” says the PF about Daimler.
“The data presented allow you to note that, in the 2020 and 2022 years, the declared revenues were not enough to support the expenses, indicating a possible incompatibility between the informed income and the expenses made.”
Regarding Marcio Toledo, the same considerations on discrepancies and suspicions on the equity change in 2019 and credit card spending in 2023 are presented.
One of the expressions used by the PF to point out these suspicions is that there are “discovered” financial variations, which means “to indicate the occurrence of omission of revenues or the realization of transactions not reported in tax statements”.
In a later document, with the analysis of data extracted from cell phones from investigated, the Federal Police states that there is evidence of a “bond of deep confidence” between Rodrigo Falcão and Minister Og Fernandes.
The delegate who conducts the investigation said that the then chief of staff had widely active, “supposedly as an assistant of orders from the minister, providing direct and continuous support in both professional routines and personal needs of his superior, such as: payment of slips, finance organization, document organization and spreadsheets, among others.”
“The depth of the confidence established between them manifests itself to the extent that Rodrigo allegedly had access to registration, banking, tax and financial data of the minister and also his wife,” says the analysis.
“This is a prerogative that reinforces the degree of intimacy and confidence between them, reflecting a relationship that, in theory, transcends the limits of professional formality.”
STJ documents point out that the role of minister’s chief of staff has a broad jurisdiction, and even includes “performing any other attributions resulting from the office, or being commended to them by the minister or the minister.”
In a statement, Daimler’s defense points out that the PF says in the tax analysis report on its client that the assessment was made based on income tax statements and that “there were no declared real debt and burden records, that is, possible amounts credited to Daimler Alberto de Campos account due to the constitution of banking debt”.
The lawyers referred to the reports that indicate “the hiring of several personal loans that, according to the Judicial Police itself, are not contained in income tax statements that served as the basis for the analysis and conclusion contained in the report”, which could justify the additional revenue.
The defense states that Daimler does not know Andreson and that “never kept in touch, directly or by interposed person, whether by connection, application messages or emails.”
“As a obvious consequence, he never dealt with any process, much less received from him any value, either by transfer, deposit or any other means,” says the note, signed by Daniela Rosa Alves Coelho and Haroldo Trindade Júnior.
Márcio Toledo’s lawyer, Breno Gut, says that he will only speak in the case file, at the appropriate time. The defense of Rodrigo Falcão de Oliveira Andrade did not comment.
