The marriage of members of the Upper House recognized the events on April 30 and apologized. The Assumption of Responsibility came after having tried for months of getting out of success, of internal accusations alleging lack of arbitrariness, helplessness and blaming other colleagues. Some allegations that a month ago admitted as unfounded as their own. Thus it follows from the disciplinary file initiated by the institution, which has accessed the country, and that ended with its dismissal last week after a long and turbulent chapter for the parliamentary institution ,.
The investigation collects 51 interventions online improper of him and 23, from her, from March to October 2024, to “positions, officials and workers of the General Secretariat of the Senate, as well as to the documents contained in them.” But the text also reiterates that, in any case, the “abundant downloads of documents, including some personal nature” had as the sole purpose of data on the position of head of department, for which both they and two other workers had submitted their application. The story of the facts is as follows.
Department Head Station. The Upper House had opened a call to opt for the position of Project Chief in the Development Area of the Directorate of Information and Communications Technologies of the General Secretariat of the Senate. In that position, both the dismissed marriage and two other workers were presented as applicants. The latter, however, with less “possibilities” of achieving the square – qualified from the beginning as “convulsive” – by having less seniority and experience than the husband, as detailed by the text.
Undue access to portfirmas. In October, the file instructor warns that, since March 2024, the accused had agreed to “portfirmas of certain positions, officials and workers of the General Secretariat of the Senate, as well as the documents contained in them”. The portfirmas is a Senate application to sign documents electronically. Of course, the text acknowledges that “a lot of relevant information” is housed in this “tool”. And he points out that the two computer scientists had consulted “confidential documentation related to different areas and specific people” through those portfirmas “frequently.”
Among those accesses, the file is 51 intrusions from him and 23, from March to October 2024. “The undue accesses are related to the resolution of said contest,” the file affects, alluding to the selection process to Project Chief. “Senate activities have not been harmed at any extreme,” he concludes.
What they were looking for if he was the favorite. The incongruous thing is that the husband, with more than 20 years of experience, was objectively above the other applicants. Why find more data and run the risk? The instructor’s thesis is that, as the wife also aspired to the position, what he was allegedly intended to depart from the selection process so that she was chosen in case of being above the other two. That is, in second position, behind her husband. Because he already held another position with “directives” functions and thus monopolized two high positions. Otherwise, he would have remained in his application to be the winner so that the ascent would be at least in the family.
The hypothesis, raised to the major lawyer of the upper house, is based on the fact that among the files downloaded there are documents that refer to the “merits and score” of the four applicants. Therefore, in addition, they would also have used the information so that she tried to get more points and thus exceed the other two if they were below the opponents. Some data that, highlights the file, are not available to applicants in the selection processes.
A long process. After warning the intrusions and showing them last October, the upper house opened the sanctioning process. It is a long process in which the two workers, who then took a medical decline, presented allegations denying the facts, denouncing lack of impartiality by the instructor and blaming their classmates from other undue accesses. In those answers, both presented a list of names whose signature trays would have been accessed. Although this newspaper cannot verify at that time they referred to they were made by themselves or accusing their peers.
Among the list of affected names – 74, from an IP address, and 15, from another – are the major lawyer, the president of the Senate, two vice presidents, two secretaries, several senators and several workers of the upper house. In good part of the cases, there are also download of documents, not only access to portfirmas. The Senate, on the other hand, and contradicting a first statement – that the senators had not been affected by interference.
The process followed its course. The instructor persisted in his accusations and also found new attempts at improper accesses after October. The “premeditation, reiteration and recidivism” caused the decision taken at first employment suspension to go directly to the dismissal of both. The major lawyer supported the resolution based on the evidence provided by the instructor and highlighted the “vicarial nature of the administration” of the Senate ” – also of the parliamentarian – at the service of the general interest, which must always be above the particular interests of its employees.” So from the acts verified “a damage to the parliamentary institution itself is derived, as well as a damage to the general interest.”
Sorry and dismissal confirmed by the table. Finally, and after the attempt to excuse themselves, on April 30 the marriage sent a letter to the Senate in which they recognize the facts, ask forgiveness and deny that there would be evidence against their peers. “We assume our responsibility for what happened and express our most sincere repentance,” they indicate in the letter. “At no time there was a will to cause damage to the good name, operation or integrity of the Senate. From the beginning of the file, we are in a situation of temporary disability motivated by circumstances that exceed the scope of our emotional vulnerability. In the development of our defense, we recognize that we have not lent the desirable collaboration to the file, conditioned both by the fear of the situation and by the advice received Literate, ”they add. And they ask to stay in their position.
Despite the letter, the major lawyer maintained the proposal for the resolution of dismissal. The Senate table is the one who has the last word. And on the 21st, at an extraordinary meeting, he unanimously decided to fire the two workers – with four votes in favor of the PP and three of the PSOE.
Technical consequences and political anger. The internal problem, to which the dismissal has given a folder, has nevertheless technical consequences. The file recognizes that the four computer scientists could access the portfirmas of their lordships, although for a different purpose, related to their work mission.
