The Moroccan police who had asked asylum at the border of Ceuta and to which the Ministry of Interior denied it can remain in Spain while the National Court studies the appeal that the agent presented in the courts. Interior argued the denial on which the agent’s request was based “on incoherent demonstrations” or that contradicted “sufficiently contrasted information about their country of origin.”
Now the Contentious-Administrative Chamber of the National Court granted on May 23 and has recognized its right to remain in Spain as asylum seeker.
The agent requested international protection because he assured something that led him to leave his position in the police, and because he fears being undergoing if he returns to his country, legal sources detail.
The Chamber has explained in a car that to grant this very precautionary measure “there must be a serious risk for the life or physical integrity of the foreigner”, for some of the reasons that justify the concession of asylum, and that must be assessed according to objective characteristics of the country of origin and the personal situation of the asylum applicant.
Regarding the argument that the Ministry of Interior wielded to deny the request for asylum, the Chamber considers that “it cannot be denied that non -disconnected reasons from international protection are alleged.” “In principle, they are not clearly incoherent and contradictory allegations, manifestly false or obviously unlikely or that they sufficiently contradict contrasting information on the country of origin, and clearly show that their application is little convincing in regards to compliance with the requirements to be a beneficiary of international protection,” they have argued.
The Chamber mentions two UNHCR reports in which it is considered that once its lace is determined in the political motifs provided for in the definition of refugee of the Geneva Convention, as well as Law 12/2009 “their allegations cannot be considered manifestly implausible, incoherent or contradictory, having made an effort to make a coherent and credible story offering detailed information about the aforementioned information about alleged ”. The court has also taken into account the media impact of this request, both in national and regional media, alleged by the applicant.
