The United States International Commerce Court has decided that President Donald Trump exceeded his authority by imposing global tariffs on imported products, in an important setback for one of the main fronts of his economic policy.

The decision, announced on Wednesday (28), states that the White House improperly used an emergency law to justify the adoption of tariffs against virtually all countries.

According to the Judges of the Court, based in Manhattan, the US Constitution grants Congress the exclusive power of regulating foreign trade, and this provision cannot be overlapping unilateral measures of the Executive.

With this, the court understood that the tariffs imposed by Trump do not find enough legal support.

Trump’s government may appeal the decision in higher courts of the Federal Court.

The action was filed by Liberty Justice Center, a nonpartisan legal center, representing five small American companies that depend on the importation of products affected by tariffs.

This is the first major legal challenge to the so-called “Liberation Day” fares, as they were nicknamed Trump.

The measures were announced on April 2 and caused great instability in the global financial markets.

Since then, part of the rates has been reversed or softened as the US government has negotiated exceptions with different countries.
