Mc Poze declares to the CV? Defense rebate and jurists explain practice

The information that Mc Poze do Rodo was a member of the Red Command (CV) during the screening in the Rio de Janeiro Penitentiary System raised a series of questions since Friday morning (30). The statement was registered in the singer’s record, which was sent to a wing for prisoners linked to the faction in the Dr. Serrano Neves Penitentiary, in the Gericino Complex, in Bangu, in the West Zone of Rio.

But, after all, what does this self -declaration mean? Does it confirm direct bond with organized crime?

Criminal lawyers heard by CNN explain that this practice is part of the routine of the Fluminense prison system and its main objective is to ensure the physical integrity of the prisoner.

“The prisoner, when he enters the system, is asked about his faction or the predominant faction in his home community. This serves so that he is not put in a wing where there are rivals prisoners, which would put his life at risk. It does not necessarily mean that he is part of that faction, but a measure of self -protection within prison,” explains criminalist lawyer Patrick Benedito.

According to him, if the prisoner declares himself neutral – that is, without bond with any faction -, is directed to specific units, which are few in the state of Rio de Janeiro. Options include the José Frederico Marques Public Prison in Benfica, where Poze initially was custodian; The Laércio da Costa Pelegrino Penitentiary (Bangu 1), which operates under absolute isolation regime and rarely receives provisional prisoners; and the Custody House in Itaperuna, in the interior of the state. “There are very few units considered neutral,” reinforces Benedito.

Still, according to him, even in these units the prisoner may end up vulnerable.

“In the case of Poze, his own songs are associated with a particular faction, which could generate risk, including neutral units. The choice of self -declarating CV is often a measure of self -protection,” he adds.

Criminal lawyer Marcos Oliveira, in turn, warns of the disclosure of official documents with personal data of the singer. “Although the prisoner has made public statements, the State has legal duty to confidential about data contained in official records. This is protected by the Constitution and the General Law on Data Protection (LGPD),” he says.

He adds: “Disseminating official documents with sensitive data can configure violation of functional confidentiality, as well as generating administrative, civil and even criminal liability, except for exceptions provided by law, such as judicial authorization or risk to collective security,” he says.

The artist’s defense reinforces that this self -declaration, made during screening, has no legal effect and serves only to ensure the safety and organization of cells, considering the prisoner’s origin community.

“This practice, under no circumstances, brings or could bring any degree of certainty about affiliations, associations or any bond of the genre,” says lawyer Fernando Henrique Cardoso, who represents MC Poze.

The defense of the singer also states that the arrest was made in a spectacular way, with abuse of authority, misuse of handcuffs and search and seizure outside legal limits.

“So far, there is a court decision that will have its grounds discussed in the judiciary through a habeas corpus,” says the defender.

The Secretary of State for Penitentiary Administration reported that the criteria adopted for the division of inmates in the prison system are confidential.

“Information on the internal division of custodians is confidential as they are related to strategic procedures of the penitentiary administration,” he said in a statement.

Seap also stated that it opened an inquiry to investigate the leakage of information involving the name of Marlon Brendon Coelho, MC Poze do Rodo. “The disclosure was not authorized and hurts institutional security standards,” he said.

Tumult and support on the streets

The singer’s arrest also generated turmoil and mobilization on the streets. During the dawn, supporters groups made a “roll” of motorcycles and even caused a principle of confusion in front of the José Frederico Marques public jail in Benfica, in the north of Rio. Police had to intervene and disperse protesters.

Mc Poze do Squeegee was arrested on Thursday (29) during an operation of the Narcotics Suppression Police Station (DRE). He is investigated for association with trafficking and criminal organization.
