Lawyer Soraia Mendes and the businessman and former deputy Alexis Fonteyne discussed on Thursday (29), in The Great Debate (Monday to Friday, at 11pm), if the resumption of the Judgment of the Internet Civil Mark, which regulates the Big Techs, is a response from the Supreme Court (STF) to the possibility of the United States to sanction authorities of the Brazilian judiciary.
O The date was set less than a day after Donald Trump’s government threatens to block visas from foreign authorities who, according to the country, censor Americans.
For Soraia Mendes, the Supreme decision is not directly related to the actions of the United States Government. “The Supreme does not fall into arm wrestling with any political group. Who comes to an offensive against the STF and against Brazilian sovereignty is the Trump government, which puts our citizens under the aim of their interests.”
Soraia also relates the attempt at American interference in the Brazilian state with external interference that occurred during the military dictatorship.
“It’s like saying, ‘Either you Brazilians agree not to punish those who are scammers or let’s retaliate your authorities.”
For Fonteyne, the resumption of the Judgment of the Internet Civil Marco is not only a response to Trump government actions, as is also an intrusion of the Supreme to the Legislature. According to the former deputy, the Brazilian Court wants to reinterpret Article 19 of the Constitution, which deals with the right to freedom of expression.
“There is nothing that forced the big techs to remove content from the air without a court order,” he said.
He also points out that recent speeches by President Luiz Inacio Lula da Silva (PT) on the return of the trip to China generate the fear that Brazil is planning to adopt the Chinese model of regulation of networks, which, in practice, would be configured in censorship.
“Lula asked for a visit from a high Chinese government official, a social networking expert, because they are better used on the right. That is, he wants to shut up. He wants to prevent the debate,” he said.
