Pamela La Rosa has seen her daughter again, not for a visit, but to take her with her. He had been waiting for this day since he was born, because the rose gave birth on March 26 and 28, “for the risk” for both the girl and the mother for the process for sexist violence who has open after a complaint to the father of her daughter last February ,.
The rose is not forgotten even the first ten days that happened, without knowing anything about her, nor the following weeks, in which he could only see her for a while, first one and then twice a week, but today, that the community has returned to the girl, “more than anything,” is “happy.” And it will be a little more, and “quietly”, on Wednesday of next week, when he signs the guardianship of his daughter, who has been these months in the hands of the community.
For the rose it has not been easy to face these last two months to a situation that he never thought when he decided to move to Spain. He arrived from Peru just half a year ago, on December 4, 2024, already pregnant and only with what was his partner, the girl’s father. She is 22 years old and these two months has been accompanied and wrapped by a group of people who have helped her, and for a couple of weeks she has also done one of her sisters, who traveled from Peru to be with her. But from the beginning he put on the table “the dark” that looks everything when you are in a foreign country, without knowing the legislation, bureaucracy and institutions and “see, suddenly, that they take away your daughter and you are alone.”
The origin of this situation is in February, when the rose denounced his partner “for an episode of violence” and a judge imposed a restraining order on him. The ex officio lawyers, both of her and him, recommended that they fix it because “it had not been so serious.” And she and he decided to pay attention to them because “the most important thing” was that the girl was about to be born.
When on March 25 at night the rose got in labor, the 31 -year -old’s father, was the one who accompanied her to the hospital, the Torrejón de Ardoz. He gave birth about three o’clock in the afternoon of the 26th, and the next day, the police went to the hospital to detain the father “by”, as they confirmed then. And on the 28th, Friday, from Social Services they retired to the girl without giving her any option. She told those days that had not even told her where they took her or if she could see her, only that she returned spent the weekend to inform her.
From the hospital they explained at that time that “in all hospitals there is an obligation to notify the competent authorities when a situation of helplessness or risk for the baby is perceived, as happened in this case.” And it was when they warned social services: “And the Community of Madrid is responsible for taking the appropriate measures for baby safety, the hospital can no longer decide anything.”
The rose wondered last April “at what time” his daughter helped: “If all he wanted, they didn’t separate me from her. I didn’t abandon her, they took it away.”
And the family counseling, on which it depends, said that “a withdrawal in the hospital occurs because there are serious risk indicators for the baby. In any case, the measures are always established, trying to family reincorporation in the fastest possible way, but always guaranteeing the safety of the child. Like all administrative measures, the situation of the minor is supervised by the Prosecutor’s Office and the decision can be resorted to the judge”.
Thus, the daughter of the rose became under guardianship of the community – without notifying the rose until several days later – and on April 4 the baby was delivered to a provisional host family. Meanwhile, she has been in a center for women victims of sexist violence, and had supervised visits first once a week, and then two, at the Institute of the child. Until Friday, when you can return to that center, with your daughter.
