USA: Trump duties – Court of Appeal “froze” their cancellation temporarily

Federal Court of Appeal of the Court of Appeal has decided to temporarily suspend the ruling of the Court of Justice of International Trade, which had blocked the President’s duties.

In particular, it ordered both sides to submit written arguments on the issue of suspension of duties, with a deadline for the beginning of next month.

The International Trade Court had ruled on Wednesday that Trump did not have the power under the law on international financial powers (IEEpa). The Trump administration immediately appealed, paving the way for a legal controversy over an economic policy that Trump promises to repair the US economy in industrial production, but which may raise prices for small businesses and consumers.

The three -member composition of the International Trade Court blocked all the duties imposed under IEEPA – the so -called “Liberation Day” duties announced by Trump on April 2, as well as the duties imposed earlier this year. It is noteworthy that the decision does not include 25% duties on cars, spare parts, steel and aluminum, which had been imposed by a different law, Article 232 of the Extension of Trade.

Levit: The issue has already been judged

On Thursday, the White House strongly condemned the decision. Karolin Levitt’s spokesman defended Trump’s imposition of duties in the context of a national emergency, saying the issue had already been “judged by Congress”.

He described the three judges of the composition as “activists”, although one of them was appointed by Trump himself during his first term, and argued that “threatening to undermine the credibility of the United States on the international stage”.

Levit denounced what she described as an attempt to “blatantly abuse their judicial authority to usurp Trump’s power”.
