It determined this Friday (30) the revocation of the mandate of the councilman of São Paulo Rubinho Nunes (União Brasil), for replacing in his social networks false report published by which he associated with the use of cocaine, in the municipal campaign of 2024.
The decision is first instance, and the councilman will appeal.
In his decision, Judge Antonio Maria Patiño Zorz also condemned Rubinho to eight years of ineligibility.
In his defense, the parliamentarian said he kept the post on the air for just 26 minutes and did not know that the report was fake.
The councilman also clung to the fact that the Electoral Public Prosecution Service has manifested himself contrary to the ineligibility for eight years.
“I respect the magistrate’s decision, but I vehemently disagree. We will resort to TRE with awareness that there was no illegality,” says Rubinho.
“Regarding the report of the report, it had been published by the candidate for mayor [Marçal]without any interference of mine. As soon as there were news about the falseness of the report, the post was immediately removed, “adds the councilman.
For the judge, the argument that Rubinho did not know about the veracity of the report is not enough to rule out his responsibility.
“I understand that the sharing of the false report disclosed in the media, the candidate’s own Instagram ends in itself an unlawful conduct that boasts the potential of injury to the protected legal good, the legitimacy of the elections,” wrote Zorz.
The decision indicates that Marçal himself has a great chance of being ineligible.
Upon learning of the punishment to the councilman, Boulos spoke out. “Rubinho Nunes’s cassation, as well as the complaint against Pablo Marçal, for the dissemination of absurd fake news against our candidacy in 2024 is a victory, albeit late, of democracy,” said the pentalist. “May justice be done, and both pay for their crimes.”
The action was filed by Leonardo Grandini, candidate for councilor for PSOL in Sao Paulo and was not elected.
