Former President Jair Bolsonaro (PL), defendant in the action, accompanied the first day of testimonials on March 19. The rapporteur of the action, Minister Alexandre de Moraes, was responsible for conducting all hearings. The function is usually attributed to an auxiliary judge. Moraes also invited the other ministers of the 1st Panel of the Court to attend. Only Flavio Dino did not attend and sent a representative.
At the time, the witnesses of the PGR (Attorney General of the Republic) spoke: Éder Lindsay Magalhães Balbino, Clebson Ferreira de Paula Vieira, Adiel Pereira Alcântara and former Army commander Marco Antonio Freire Gomes.
Moraes General Freire Gomes in his statement. The rapporteur was annoyed with the military after the former commander presented a different report from the one taken to the PF (Federal Police) during the investigations.
“The witness cannot omit what he knows. He lied to the police, has to say that he lied to the police. He can’t, before the STF, say he doesn’t remember. I ask that before answering think well.”said Moraes.
To the corporation, Freire Gomes would have said, according to Moraes, that the General and Brigadier Baptista Júnior would have placed himself against the document presented by Bolsonaro who discussed a state of siege, state of defense or GLO (Guarantee of Law and Order), to effect the “Democratic institutional rupture”. Admiral Almir Garnier, defendant in the criminal action, would have consented, however.
To the STF, Freire Gomes softened the version and said he could not “infer” Garnier’s intention in answering. The military also did not confirm that he gave “Prison voice” Bolsonaro when he presented what would be the draft of the coup. Said he only warned him about “Legal implications”.
The next day, the Supreme Court listened to the former Air Force Commander Carlos Almeida Baptista Júnior for 1h30min. Brigadier’s statements were one of the main evidence used in the PGR complaint.
The brigadeiro confirmed that Freire Gomes threatened to arrest Bolsonaro, with “Very calm”. He confirmed almost all of his statement to the PF, but reformulated that he could not be sure if the then Minister of Justice, Anderson Torres, attended the meetings in which the scammer measures were discussed.
He reported that until today social networks for not joining the attempted coup and witnessed about arresting Minister Alexandre de Moraes.
On May 23, Moraes is a discussion with former Minister and former Federal Deputy Aldo Rebelo and threatened to arrest him for contempt. He was depicted as a witness to former Navy commander Almir Garnier.
When asked if Garnier could, alone, mobilize Navy troops to make an attempted coup, as stated in the PGR denunciation, Rebelo replied that the military’s speech was a “Expression Force”.
Rebelo, however, was not at the meeting where the dialogue would have happened. Given the negative, Moraes said he could not “Evaluate the Portuguese Language” in a testimonial and the chat began:
“My appreciation of the Portuguese language is mine. I do not admit censorship”said the former deputy. Moraes replied: “The Lord will be arrested for contempt if the Lord does not behave”. “I’m behaving. Will you admit that I do my appreciation?”said the former minister.
In an interview with Poder360Rebelo who expects an apology from the minister after the episode.
Over the two weeks of testimony, Moraes rebuked other lawyers and witnesses. I didn’t want “circus” In his court when one of the lawyers repeated questions exhaustively. Also that witnesses cannot give “Personal interpretations”.
